Earlier today, Judge Ada Brown of the Northern District of Texas issued an order that permanently blocked the FTC's Final Rule Banning Non-Competes, which was previously set to take effect on September 3, 2024. Employers can now continue to rely on valid and enforceable non-compete agreements, but should ensure they comply with state laws. On July 23, 2024, a United States District Court Judge in Pennsylvania denied a request for an injunction to prevent the FTC’s rule on non-competes from becoming effective September 4, 2024. This decision contrasts the Texas Court's decision from earlier this month. While a lot is still unknown in terms of the ultimate fate of the FTC’s rule, one thing has become slightly clearer as a result of the Pennsylvania decision. Our nation’s courts may not align on whether the FTC’s rule is legal, and it is possible the issue will have to be ultimately decided by the U.S. Supreme Court.
