Throwback Thursday! While the doctrine of forum non conveniens has come under attack in recent years, it is still a useful tool to avoid forum shopping that will adversely affect your client. In Larson v. Illinois Central School Bus, LLC, 2023 IL App (3d) 220360, the minor plaintiff was injured while being transported on a school bus owned by defendant and driven by defendant’s employee. While the accident occurred in Texas, the plaintiff tried to forum shop and brought the lawsuit in Illinois where the bus company’s principal place of business was located. The plaintiff claimed the bus company was negligent for, among other things, failing to train its employees and failing to implement policies for safely transporting passengers and argued that the company’s directors would testify about the company’s policies and procedures. The appellate court agreed with the bus company’s position after considering the public and private interest factors.
