🌍 Setting a Precedent: The Advisory Opinions of International Courts and the States’ Duty to Phase-Out Fossil Fuels At the forefront of global legal battles, international courts like Inter-American Court of Human Rights, International Tribunal for the Law of the Sea/Tribunal international du droit de la mer, and International Court of Justice (ICJ) are pivotal in defining state obligations amidst the climate crisis. Recently, we participated in hearings at the Inter-American Court of Human Rights, stressing the urgent need to phase out fossil fuels to protect human rights and meet international climate commitments. Key issues discussed included the disproportionate impact of climate change on vulnerable regions, driven primarily by fossil fuel emissions. Our intervention highlighted the critical role of public finance in either advancing or hindering global climate goals, emphasizing transparency and accountability in financing institutions. These advisory opinions serve as crucial pillars of international law, guiding states towards more sustainable energy practices and reinforcing commitments under the International Law. We also see fossil fuel industry’s interests behind every major barrier to a clean energy transition. We are a small, nimble organization with many decades of staff expertise in campaigns as well as expertise in the economic, financial, social, and environmental issues surrounding the fossil fuel industry. Using this knowledge and experience, we craft strategic, incisive campaigns, supporting a diversity of strategies and tactics to challenge the influence of the fossil fuel industry.

Today, together with 31 other organisations from the US Gulf South, Europe, Japan and elsewhere, we are publishing a letter demanding European and Japanese banks to rule out financing for LNG infrastructure projects in the US Gulf South Coast. Banks like ING, Intesa Sanpaolo, Deutsche Bank, Mizuho, MUFG, Crédit Agricole CIB, Sumitomo Mitsui Banking Corporation – SMBC Group and Banco Santander have poured billions of dollars into LNG projects & companies in the Gulf South, contributing to human rights violations, environmental degradation and environmental racism. We call on banks to: ✅Rule out direct financing for LNG projects in the Gulf South Coast ✅Provide remedies and compensation for harm done ✅Introduce a policy excluding financing for all midstream projects and companies expanding the LNG sector. Our February 2024 report, On Thin Ice, found that the EU’s demand for gas is set to decline significantly in line with climate targets, eliminating the need to expand supply - i.e. producers such as Norway should stop all new oil and gas extraction & exports. Today our partners at Zero Carbon Analytics released an updated analysis showing that gas supplies from existing projects are enough to meet the EU’s gas demand in 2040, if it adopts the proposed 90% emissions reduction target proposed by the European Commission. This confirms that new gas extraction projects are not needed to meet the EU’s long-term needs for gas, yet many countries like Norway are currently planning to increase their gas exports to Europe. This is not only a financial risk, but also a significant threat to achieving the Paris climate goals. As the Export-Import Bank of the United States continues to fund billions in fossil fuel projects despite President Biden’s pledge to stop, anger is growing. Yesterday, while youth groups and allies protested outside the US EXIM Annual Conference, forcing delegates to walk past bloody banners representing EXIM’s financing, Climate Defiance shut down EXIM President Reta Jo Lewis, Esq.’s keynote speech. Joe Biden repeatedly made a promise to end US taxpayer finance for international fossil fuel projects. If he wants youth climate voters on-side, he must use the power he already has to end EXIM’s multi-billion finance for fossil fuels - now.

NEW: Oil Change International research shows that ahead of next week's G7 summit, G7 countries are ramping up fossil fuel expansion plans at home and investing billions in fossil fuel infrastructure abroad. We find that: - G7 countries account for 27% of current global coal, oil, and gas production. - The U.S., UK, and Canada could be responsible for nearly half (48%) of the CO2 pollution from new oil and gas extraction projects planned between 2023 and 2050 - equivalent to the lifetime emissions of nearly 600 coal plants. - Between 2020 and 2022, the G7 provided USD $25.7 billion each year in international public finance for fossil fuels, compared to USD $10.3 billion for clean energy. - Only 1% of the G7’s clean energy finance went to low-income countries. 88% of their support was in loans to low- and lower-middle-income countries, worsening the debt crisis. The summit is the first opportunity for the G7 countries to demonstrate their commitment to the implementation of the COP28 decision to transition away from fossil fuels, and the last time these governments meet before submitting enhanced climate plans under the Paris Agreement. G7 nations can and must lead COP28's call to end domestic fossil fuel expansion and halt public finance for fossil projects. Instead - they are planning for massive expansion of fossil fuel production at home and funding billions of dollars for fossil fuel projects abroad. Our data shows that G7 countries account for almost half of planned oil and gas expansion - equal to the lifetime emissions of nearly 600 coal plants - while also pouring $25.7 billion into fossil fuel projects abroad each year. At the upcoming G7 Summit, these countries have an opportunity to show their dedication to implementing the agreement made at COP28 to transition away from fossil fuels, and prioritize support for clean, affordable energy where it’s most needed on fair terms. Another scientific study shows that there is no need for new oil and gas projects. The world has enough fossil fuel projects planned to meet global energy demand forecasts. Meanwhile, Shell has hundreds of new projects in the pipeline. The report we launched in March with Oil Change International shows that: 1. Shell has plans to develop over 800 new oil and gas projects in the coming years. 2. The emissions stemming from these projects would equate to 38 times the emissions of the Netherlands in 2021. 3. Since the court’s verdict in 2021, Shell has approved 20 new fossil fuel projects and given the green light to initiate drilling. All new projects Shell has planned are in violation of the Paris Agreement, and each one is an investment in more climate destruction.
