The US EPA is currently considering whether to permit an mCDR research project proposed by the Woods Hole Oceanographic Institute. Last week, the Sabin Center submitted comments supporting EPA's authority to permit the project under the Marine Protection, Research, and Sanctuaries Act. We specifically counter other comments suggesting that the MPRSA does not authorize EPA to issue research permits for mCDR projects and/or that such projects require permits under the Clean Water Act. In our view, the statutory framework is clear -- the MRPSA applies and the CWA doesn't, at least in this particular case.
