A California appeals court just ruled that it's okay if a juror lies and hides requested information in jury selection - as long as the information concealed does not have a direct and obvious connection to the case, the juror does not share the relevant experience with other jurors, and the results reached by the jury don't appear to have been impacted by the withheld information. The juror failed to disclose prior court cases in which he was involved out of, he said, embarassment - understandable given that they were sex crimes. They were also crimes that were more than 35 years in his past. Justice Donald Franson wrote, "Neither of the court cases - a felony criminal case in Washington and a personal injury suit in which he was plaintiff - relate in any manner to the current case or are likely to have influenced Juror No. 10's impression of the current case." It's a pragmatic decision that sets the juror's misconduct in the broader context of a long trial and a jury of 12 making a decision - but I'm not sure that the message delivered, that it is ok for a potential juror to lie and withhold information is a good one. The decision also fails to account for the powerful subconscious effects of a person's experiences on their decision making. Chances are if this juror had been honest in voir dire, he would have been stricken and the dynamics in the deliberation room would have been very different. #juryselection #astc #voirdire #trial #jurytrial
