As reported by NBC News, STAT, and others, the House Committee on Oversight and Accountability held a hearing to investigate evidence of pharmacy benefit managers (PBMs) conducting anticompetitive practices driving up consumer healthcare costs. This is on the heels of an interim report from the Federal Trade Commission’s (FTC) investigation of PBM business practices, which was also prompted by complaints of anticompetitive behavior. Meanwhile, several bills have been introduced aiming to regulate PBMs. The three largest PBMs control about 80% of the market, and are vertically integrated with health insurers, pharmacies, and providers. While vertical integration can benefit consumers, it can also create opportunities to profit at the expense of patients and plan sponsors, and foreclose competition from rivals. Recent reporting by The New York Times, The Wall Street Journal and the Federal Trade Commission (FTC) explores the role of pharmacy benefit managers (PBMs) in determining U.S. spending on prescription drugs. Although PBMs are meant to reduce our spending on prescription drugs by negotiating with pharmaceutical companies and pharmacies, they appear to frequently do the opposite. Instead, these investigations suggest that PBMs are harming competition in the drug supply chain by steering patients toward their own pharmacies and more expensive drugs, and using their market power to charge high markups and hidden fees. Increasingly, patients' first awareness of PBMs comes from encountering problems accessing their medications and facing potentially dire health consequences. Several bipartisan Congressional proposals aim to regulate PBMs. However, it is unclear whether reforms will dampen their ability to deliver as negotiators.
