Blame it on the Machine: A Socio-legal Analysis of Liability in an AI World
Washington Journal of Law, Technology and Arts
As technology continues to evolve, interactions between humans and artificial intelligence (“AI”) will skyrocket. It is important to understand the impact AI can have on society, as well as the potential harm and subsequent liability that could result, and to develop best practices designed to address them. The U.S. needs a comprehensive framework to govern the design, creation, use and risks associated with AI. At the time of this writing, no such framework has been implemented.

This article takes a socio-legal, interdisciplinary approach to explore ideas on socio-ethical concerns and theories of liability related to AI, and applies a sociological perspective to assess existing legal frameworks that currently govern human-AI interaction. By adopting an interdisciplinary approach, this article seeks to encourage holistic and robust dialogue about how AI could be developed and operated, hoping that humans and AI can coexist harmoniously. It also proposes a framework to regulate such development in the U.S.Other authorsSee publication -

Developing Cross-functional Skills in a Changing World

As collaboration across multiple teams within firms becomes the norm, it is often very helpful to have at least a functional knowledge of how other groups work to add value to the organization. But given the challenges of individual learning styles, remote workforces and time pressures from daily work responsibilities, how can one develop cross-functional skills? High Velocity Vendor Restructure
A technology client wanted to analyze two decades of vendor agreements to support its vendor restructure strategic initiative. Our job was to identify and analyze 7000 documents for three target provisions (1) geographic restrictions; 2) website restrictions; and 3) unilateral modification) within 5 days so that the client could use that analysis for its restructure. To meet the client's needs, I managed a cross-functional team that developed streamlined workflows to disaggregate and review the target data. We leveraged lower-cost contract attorneys, to reduce costs to the client and facilitate a flat fee engagement, and deployed project management techniques, including quality control measures, to ensure timely, high-quality delivery. The team leveraged Relativity, typically used for discovery, to act as an integrated system to a) review documents and comment on provisions; b) act as an escalation mechanism to ensure quality and alignment among the multiple reviewers and managers; c) implement a knowledge management protocol to capture reasons for escalations, notices and other valuable information to share; and d) monitor reviewer progress. Lastly, the team programmed Relativity to find its target provisions, regardless of whether the provisions were on vendor or client paper. The team captured all review results in a structured database that it delivered to the client on-time, within scope and within budget.

Deal volume is high and relentless and transaction speed is crucial. To manage the work with the accuracy and velocity that the client requires, I led a team a cross-functional team to develop improved workflows, a workflow management website to support matter intake, status tracking, and reporting. Initial improvements included elimination of a $3,000,000 invoicing backlog, reduced staff hours and reducing a certain key cycle-time by 50%.

Mobile Infrastructure Build-out

A technology client engaged us to review and negotiate agreements related to its nationwide mobile infrastructure rollout. A technology client engaged us to review and negotiate agreements related to its nationwide mobile infrastructure rollout. To get the work done, the client needed to assess over 100 jurisdictions in 20 markets across the country to find out about existing pole agreements, right-of-way franchise agreements, and information related to zoning requirements. In addition to the scale, the challenge was that the client wanted us to use less-expensive contract attorneys for the high-volume research, and to deliver the work on a fixed fee. To meet client's high velocity needs, we developed a staffing plan and fixed-fee pricing arrangement within 48 hours. Just two weeks later, I established a war room at a remote site in Washington, D.C., staffed it with five fully-equipped contract attorneys and led as project manager. In addition to training the contract attorneys, developing a phone call script, and uncovering the detailed, jurisdiction-specific information, we also created a technology system that could capture and store market data, like utility and municipal contacts and citations to governing regulations, and make it easily accessible for the deal teams to review and negotiate related agreements. As the execution team gathered and structured market data, our attorneys began to negotiate deals in high priority jurisdictions. The entire project was completed on-time and within budget.
