Tom Van Wyngarden has successfully defended Fortune 100 and Fortune 500 companies in connection with claims arising out of the release of hazardous chemicals, and incidents and investigations at facilities covered by Process Safety Management (PSM) standards and regulations. He has extensive litigation experience in the environmental, California’s Proposition 65 and Unfair Business Practices, workplace safety, commercial and toxic tort areas and has successfully resolved thousands of claims by motion practice, trial and favorable settlement.
Tom also works with clients responding to incident, PSM and Process Quality Verification investigations by the US Environmental Protection Agency, US Chemical Safety Board, OSHA, the Air Quality Management District and other state regulatory agencies. Concurrent with incident response, Tom represents clients in connection with the appeal of citations issued by OSHA and has successfully handled the largest matters tried before the Appeals Board. Tom is well-versed in the fields of epidemiology, toxicology, contaminant fate and transport, health risk assessment, groundwater and air dispersion monitoring, and drinking water distribution, having worked extensively with nationally renowned experts in these disciplines. He represents clients in the energy, retail marketplace, aerospace, oil and gas, waste management, fuel transportation, mining, biotechnology, agricultural, maritime, entertainment distribution, munitions and chemical manufacturing industries, among others.
