- What is a trademark? Having a unique trademark is really important. You don't want to use trademarks that are so similar to someone else's that it confuses people, but what's a trademark in the first place? You'd be amazed by how many people own trademark rights and how easy it is for them to find infringers. My practice includes a ton of trademark law. Trademarks, which some people refer to as brands, can really be anything. Trademarks can include names, colors, slogans, scents, and even sounds. A common examples the Coca-Cola bottle, so is the swirly font, and so is the shape of the bottle. The color red on the bottom of Louboutin shoes is a registered trademark in the United States. And so is the bong, bong, bong sound of NBC. The smell of Play-Doh? It's a trademark. Even the layout of the inside of an Apple store is trademarked.
