Citizenship (Amendment) Rules, 2024 The #Citizenship (#Amendment) Rules, 2024 will enable the persons eligible under CAA-2019 to apply for grant of Indian citizenship. These rules will now enable minorities persecuted on religious grounds in #Pakistan, #Bangladesh and #Afghanistan to acquire citizenship in our #nation. Key Highlights: Insertion of Rule 10A providing #application for grant of citizenship by #registration or naturalisation by persons eligible under Section 6B of the Act. Insertion of Rules 11A providing Authority to which application may be made by a person applying under Section 6B of the Act. Scrutiny of applications by the Empowered #Committee. Background: The Citizenship (Amendment) Act, 2019 (‘CAA’) received the President’s assent on 12-12-2019 and came into force on 10-01-2020 vide notification No. S.O. 172(E). The CAA provides for acquisition, determination, and termination of Indian citizenship. The CAA aims to facilitate the grant of citizenship to migrants belonging to Hindu, Sikh, Buddhist, Jain, Parsi or Christian #community from Pakistan, Bangladesh and Afghanistan who entered into #India on or before the 31-12-2014 and who have been exempted by the Central #Government by or under Section 3(2)(c) of the #Passport (Entry into India) Act, 1920 or from the application of the provisions of the #Foreigners #Act, 1946 or any rule or order made thereunder. The #CAA was brought into force on 10-01-2020, however, the rules for its #implementation were not brought out. I’m glad to share that my research (Legal Protection of the Right to Nationality )has been published . ‏International agreements and documents have affirmed that nationality is an inherent right of the individual. This research discusses the role of legal protection in the cases of multiple nationality and statelessness. The objectives of the research are defined as follows: to provide a legal definition of nationality, to identify the types of nationalities, and to clarify the concepts of multiple nationality and statelessness within the framework of national and international legislation. The research adopted the deductive analytical method. It included an introduction and two chapters. The first chapter addressed the definition of nationality according to the international community and consisted of two sections. The second chapter discussed the legal protection of nationality and also consisted of two sections. The research has come up with several conclusions, the most important of which are: the concept of nationality is a subject of dispute in the laws regarding the bond that connects an individual to the state. Although nationality is a strong bond between an individual and the state, it can be multiple, and a person may hold more than one nationality at the same time. The research recommended that every state should guarantee the right to nationality for those on its territory and protect this right, revise legislation, and make it keep pace with the current issues of acquiring and holding multiple nationalities.

My firm Corporate Law Group had filed two #Writs on behalf of the main opposition party Assam Pradesh Congress Committee, challenging the constitutional validity of the Citizenship (Amendment) Act, 2019 under the #equality provisions of the #Constitution. On March 11, 2024, after over 4 years, the #CAA rules were notified allowing for implementation of the law that will allow any person belonging to Hindu, Sikh, Buddhist, Jain, Parsi or Christian community from Afghanistan, Bangladesh or Pakistan, who entered into India on or before the December 31, 2014 to be NOT treated as an illegal migrant (Sec. 6B ) and given citizenship after a mere 5 years domicile (as opposed to 11 years required for naturalisation). 232 petitions have been filed thus far alleging this to be #discriminatory and #arbitrary as it leaves out certain other religious minorities. These matters are pending and are shown to be listed on April 3, 2024. Nevertheless, given the importance and urgency of the matter, we are filing an early hearing application tomorrow. Though for the #northeastindia, #CAA will not apply to certain tribal areas (as protected under Sixth Schedule), 53 cases pertaining to Assam and Tripura were separated as there are other sensitive issues at stake. The narrow Brahmaputra valley is densely populated. As per the 2011 census, only 48% of people in Assam speak #assamese and 2% speak #Bodo, the other scheduled language. Apart from the hill tribes, Assam has significant ethnic groups with unique linguistic and cultural identities. In our #writ, apart from the main constitutional challenge under Article 14, we have taken an additional legal ground that CAA nullified Sec. 6A of the Citizenship Act, 1955 that was brought in following the #Assamaccord. The Assam Accord was signed on Aug 15, 1985 between All Assam Students Union (AASU), All Assam Gana Sangram Parishad (AAGSP), Government of Assam and Government of India under Prime Minister Rajiv Gandhi bringing to a closure the six years Assam Agitation (1979-1985). The understanding was that any foreigner who has entered Assam after March 25, 1971 (date of creation of #Bangladesh) will be treated as an illegal migrant, identified, names taken off the electoral rolls and deported. The CAA 2019 and Rules 2024 now provides December 31, 2024 as the cut-off date for certain categories of these people and will give them citizenship.
