Yesterday, a Louisiana district court halted the Biden admin's unlawful attempt to rewrite Title IX into law while the case proceeds. The Biden administration continues to ignore biological reality, science, and common sense. As the court wrote in its opinion: "Enacting the changes in the Final Rule would subvert the original purpose of Title IX: protecting biological females from discrimination." Our client in this lawsuit, Rapides Parish School Board, is right to confront the admin's adoption of extreme gender ideology that would have devastating consequences for students, teachers, administrators, and families. It then situates education as part of the common good in moral and political philosophy, both of which are critical sources for the foundations of the right to education as a social right. Brown v. Board of Education was a turning point in American law and race relations. This report from LPI Senior Fellow Gary Orfield and the The Civil Rights Project/Proyecto Derechos Civiles at UCLA discusses the present realities of school segregation and the patterns of change over 70 years. Key findings include: ➡️ Schools have become less White and more Latino/a, Asian, and multiracial. White students made up 45.3% of enrollment in 2021, down from 80.7% in 1968. Latino/a students made up 28.2% of enrollment in 2021, up from 4.7% in 1968. Black students have been a relatively stable population, around a sixth of the total. ➡️ The proportion of schools that were intensely segregated (with 0–10% White students) nearly tripled over the last 30 years, rising from 7.4% to 20%. ➡️ Intensely segregated schools have high poverty levels, producing double segregation by race and poverty. Curious about other's thoughts on the claims of academic freedom. I'm thinking that the professor's defense of creating academic freedom for students, and the support of that stance through reports to Title VII do not amount to a fundamental alteration of the course itself--there is no alteration of course content, course structure, course delivery due to someone engaging in protected activity of internal reporting for review and possible investigation. A disabled student participating in their right to education, whose need for recording cannot be met through the alternative of a notetaker does not inhibit the instruction of the course or represent a fundamental alteration. It seems that the professor's effort to protect academic freedom also inhibits academic freedom for students because it restricts disabled students who need access through recording from their right to engage in learning. In my reading, the professor's stance, and reported university backing, could be a shield for faculty and students to engage in discriminatory behavior under the pretense of academic freedom.
