Phil Murphy conditionally vetoed an important bill that the Legislature had passed to give New Jersey’s craft breweries the very basic rights enjoyed by every other business in the state. Our residents should be enraged by the governor’s selfish and short-sighted actions in respect to craft breweries that are open to the public. How did this happen? In 2019, the state’s Division of Alcoholic Beverage Control — under Murphy — sent a shock wave through the craft brewing industry by enacting a “special ruling” for holders of limited brewery licenses. This order was full of protectionist restrictions that favored bars and restaurants that hold traditional alcohol consumption licenses. This did irreparable harm to our young and growing craft beer industry. Banned or restricted from our premises were things like having food trucks outside or setting up TVs for viewing sports events. The special ruling also barred or limited such diverse entertainment as a person strumming a guitar, or hosting yoga sessions. Overall, a craft brewery could have no more than 25 events a year, including live music and trivia nights. This ruling exists because of big special-interest PAC money and unfair lobbying of the governor’s administration — including the ABC — by bar, restaurant and alcohol distributors to pass specific rules that harm the breweries, which the traditional “liquor lobby” considers as competition and a threat. In addition to ridiculous “brewery tour” requirements and food restrictions, these rules have made it very difficult to for craft breweries conduct our businesses like they do in every other state that allows them. In 2022, just as our industry was starting to recover from the pandemic shutdowns ordered by Murphy, the ABC doubled down and codified the restrictions, making them required conditions on every brewery’s license. If a brewery showed a playoff game or hosted a band, it could be fined thousands of dollars. Over a dozen breweries have gone out of business since these rules were enacted. Perhaps that was the intention all along. The growth of craft breweries has led to significant economic benefits for New Jersey. Many downtowns welcome breweries with open arms because they have many positive ripple effects. Just look at communities in South Jersey like Pitman, Hammonton, Williamstown, Medford and Glassboro. We are the cozy "third spaces". People love the sense of “Main Street” community. We are the “little guys.” We are being bullied. This needs to stop. Please tell Murphy and the Legislature to stop playing games, and pass and sign the brewery bill (S-3038) or a replacement version now. Service and spares are not as excited as big new projects and equipment sales. But - many of our craft brewery customers have a critical need to keep their existing equipment running. That is why we continue to develop and offer low cost service and spare parts kit options to enable just that. Whether we get another new equipment sale someday from these breweries isn't the point. For the last 14 years I have worked as a #crebroker Space Squared to find space for Austin businesses. That means I've been lucky to work on behalf of a few breweries. I'm also fortunate to have ownership in two of them. The City of Austin's #zoning is not conducive to the brewery scene or the smaller neighborhood brewpub. There are only a few small brewpubs in a retail center or small stand alone building in urban Austin. If the City of Austin would like to proactively work to keep great uses of space that are a benefit to the community and neighborhoods their in, we should be pursuing this use to be allowed in all CS Zoned sites at the minimum. Local breweries have to be challenged with a limited amount of sites and areas they can choose to open here. Then, they have the distribution challenges due to the heavily funded distributing companies in Texas that have a lock on distro laws. Cheers to Austin Beerworks as a forward thinking company. They've wisely purchased land on Springdale. We all know they have a robust self distributing program. Let's hope they can renew in 2025 because they have a wonderful space. It's no secret that times have been tough for Australian craft breweries recently. As the platform that has funded more than our fair share, we are feeling for all the founders and investors impacted. Last week, I popped my head in at the GABS beer festival in Melbourne (hard life I know) to hear from the people running our favourite breweries and get their take on the whole situation. And of course, to sample some quality beers and eat complimentary BBQ shapes by the fistful! The quiet early session on Friday allowed me the chance to talk shop with a bunch of friendly brewers. Here’s what they told me about the state of the industry: Challenges: - 💸 Excise Taxes: Australian brewers pay some of the highest alcohol taxes globally. During COVID, the government offered delayed payments, which many brewers took up. Now, the need to repay these taxes is straining many businesses. - 🍺 Reduced Keg Sales: Brewers noted a decline in keg sales as Australians, feeling the pinch of rising living costs, opt for home gatherings over pub visits. - 🕝 Tighter Supplier Terms: Suppliers have tightened payment terms, and customers are seeking more generous ones, creating a cash flow crunch. Bright Spots: - 🤝 Hyperlocal Focus: Breweries with strong local community ties, like St Andrews Brewery, Sailors Grave, and Reckless Brewing Company are thriving due to loyal support. - 🌟 Strong Branding: Breweries with standout brands, like Mountain Culture Beer Co, are weathering the storm. Known for their adventurous spirit and dedication to quality, they’re combining great beer with a sense of community and adventure that resonates with customers. - 😁 Community Support: The camaraderie among craft brewers remains strong, as seen with all the positive vibes amongst the brewers at GABS. My takeaway was that the fundamentals of these businesses still seem sound; most issues stem from cash flow constraints. While it's disheartening to see some beloved breweries close, those that endure will emerge stronger. In fact, the world's first crowdfunding campaign speaks to this point. BrewDog raised funds back in 2009, in the wake of the global financial crisis when traditional funding sources were turning their back on craft brewers. They found that by tapping into their community of supporters, they were able to find a whole new source of capital and paved the way for the equity crowdfunding industry to grow worldwide. It was a courageous move by BrewDog to push back against the negative market sentiment, but it certainly paid off and also helped them build closer connections with their customer base in the process.
