Most of my feed might not know it, but the Office of Information and Regulatory Affairs at The White House received a Notice of Proposed Rulemaking (NPRM) (as yet unpublished) titled PTAB Rules of Practice for Briefing Discretionary Denial Issues, and Rules for 325(d) Considerations, Instituting Parallel and Serial Petitions, and Termination Due to Settlement Agreement. Stakeholders can schedule Executive Order 12,866 meetings with the administration (which they are required to take) to address any concerns they have about the USPTO and various governmental stakeholders. The odd thing about this is that the NPRM's language isn't public, so you can only guess at what it contains, but based on the 14,000+ public comments on the predecessor ANPRM—95% of which were entirely negative—I'd say nearly all stakeholders involved have major concerns about what such a rule might include, or why the agency claims it's not economically significant. https://lnkd.in/ehR2rM89
