It was great to attend the launch of the UKJT's third Legal Statement on Digital Assets and English Insolvency Law last night. Highlights for me included Chrissy Hill's description of crypto founders/builders as artists, and their canvas is code; and the lively (almost off topic) discussion around DAOs and the novel issues thrown up around the use of restructuring/enforcement tools for these (as Carmel King aptly described them) companies which aren't companies. But the fundamental message of the night, and of the Legal Statement - and as I discussed with Global Restructuring Review - is that there are fundamentally no great surprises in the Legal Statement, in that English law (and in particular English insolvency law) is and should continue to be sufficiently flexible to adapt to the emerging digital assets landscape, and R&I professionals (as well as founders and investors in the crypto space) should take comfort in the fact of the certainty and predictability that English law provides at all stages of a company's economic cycle (although there will continue to be novel issues thrown up by this space, and plenty of questions (including those not even thought up yet) which are yet to be answered in a very fact-specific way). Well done to the UKJT and in particular to the drafting team.
