In an April 12, 2024, property rights remand ruling, the Supreme Court hints at its willingness to expand its judicial review authority. Surprisingly, the Court’s potential expansion involves traditional local decisions on funding infrastructure services. Sheetz v. El Dorado County. While the case centered on impact fees funding additional road capacity associated with new development, the Court’s remand uncertainties will impact other community services already stressed with changing weather patterns, such as water supply, wastewater management, flood protection, and fire protection. The justices could not agree on whether and how to modify past legal precedent for expanding its review authority, so it remanded the case back to state courts. In the interim, the Court’s incomplete ruling creates uncertainty that will foster additional lawsuits challenging other state land-related programs. #propertyrights #infrastructure #adaptation #climatechange #EPA #landuseplanning #impactfees #unconstitutionalconditions

Air-horn-and-giant-foam-cowboy-hat-worthy-news. After 30+ years, the end is seemingly nigh for the Ordinary Cause Rules. Tucked away in this year's SCTS Annual Business Plan is the quiet revelation that the 2024-2025 civil justice reform agenda includes ongoing work on a proposal to create a new unitary set of rules for Ordinary Actions at both Sheriff and Court of Session level. No further details are given, but hopefully this will lead to consolidation, simplification and modernisation of the rules for civil practitioners. Other key reform areas for this year include the expansion of Civil Online functionality to Ordinary Cause actions (which I posted about in March in more detail) and to Court of Session matters, and a planned expansion of the use of live-streaming in civil courts. https://lnkd.in/dKsuvGve

Florida is going federal! The extensive amendments to the Florida Rules of Civil Procedure approved by the Florida Supreme Court yesterday should make litigating in Florida more efficient and analogous to federal court, which I personally love. The new rules are effective 1/1/25 and include things such as: •A conferreal requirement before filing non-dispositive motions and a certificate of conferral •Elimination of the requirement that a case must be “at issue" to be set for trial and disfavored motions to continue, which will courts should now rarely grant •60 day deadline after service to file a written response to a motion for summary judgment •Required Discovery Disclosures analogous to the Initial Rule 26(a)(1) Disclosure within 60 days of service of the Complaint •Adoption of federal proportionality requirement for discovery •Required supplementation of discovery responses #litigation #litigator #floridalawyers
