🤔Planning to work while studying in the U.S. on an F-1 visa? 🇺🇸 Here’s what you should know: ▶ On-Campus Employment allows you to work up to 20 hours per week during the school term and full-time during breaks, after getting approval from your Designated School Official (DSO). No EAD is required for on-campus employment. ▶ For Off-Campus Employment, there are two main options: Curricular Practical Training (CPT) and Optional Practical Training (OPT). CPT does not require an EAD as long as the work is part of your curriculum and approved by your DSO. OPT, however, allows you to work in your field of study for up to 12 months, and you must apply for an EAD through USCIS. This is necessary whether you choose to work part-time while studying or full-time after graduation. Start by discussing your plans with your school’s international student office to ensure all requirements are met and your visa status remains secure. "HE DON'T NEED SPONSORSHIP WHEN HE'S ON OPT" These are the important point Every Employer should know about OPT. 1. You don't have to sign any immigration forms 2. You don't have to "sponsor" the employee 3. You will provide a job offer letter...that's IT! 4. You will accept their OPT EAD as an I-9 doc The rest is up to the US university/school and the employee. Its super easy to employ a foreign student on OPT. You barely have any responsibilities at all as an employer. If you have a Ph.D., particularly in a STEM (Science, Technology, Engineering, Mathematics) field, you might be eligible to directly obtain a Green Card in the United States through the EB-2 visa category, specifically the National Interest Waiver (NIW). Here’s how: Eligibility: Advanced Degree: Holding a Ph.D. qualifies you for the EB-2 category as it is considered an advanced degree. National Interest: To apply for a National Interest Waiver, you must demonstrate that your work benefits the national interest of the United States. Application Process: Form I-140: File the Form I-140, Immigrant Petition for Alien Workers, with the U.S. Citizenship and Immigration Services (USCIS). This petition does not require a labor certification, which is a key advantage. Supporting Documentation: Provide evidence of your advanced degree, your research or work that benefits the national interest, and your ability to advance in your field. Self-Petition: Unlike other employment-based visas, the NIW allows you to self-petition, meaning you do not need an employer to sponsor you. Steps: Prepare Your Case: Gather documentation proving your qualifications and the importance of your work. This can include publications, citations, letters of recommendation, and evidence of your research’s impact. File the Petition: Submit the Form I-140 along with your supporting documents to USCIS. Adjustment of Status: If you are already in the U.S. on a different visa, you can file Form I-485, Application to Register Permanent Residence or Adjust Status, simultaneously with your I-140 if visa numbers are available. Approval: If USCIS approves your petition, and your priority date is current, you can proceed to get your Green Card either through Adjustment of Status (if you are in the U.S.) or Consular Processing (if you are outside the U.S.). Benefits: No Labor Certification Required: The NIW bypasses the labor certification process, which can be lengthy and complex. Direct Pathway: Having a Ph.D. in a STEM field can significantly strengthen your case for national interest, potentially expediting your Green Card process.

I applied to the same job using two different emails but changed one thing. In my first application, I said I needed visa sponsorship. I got rejected in less than 24 hours. When I applied a second time, I said I didn't. A week later, I'm currently in "review." Which means I would never work for them Even though they're a well known environmental organization. International students are talent. We should be valued as such. I've been lucky enough to work for a few companies that do! 💡What should companies do about this? Tell your applicants! In the job description include a section that says you can't sponsor. Include it under your Equal Employment Opportunity phrase. The one that says you don't discriminate based on race, gender... and national origin. 🤷 💡What should international students do? Personally, I lean on always telling the truth. Granted, when we talk about EB2 NIW, H1Bs and AOS, truth becomes blurry. But you'd want to work with a company that values you. So start with valuing yourself. Categories: 1. O-1A (Sciences, Education, Business, Athletics): - Requires sustained national or international acclaim and top expertise. 2. O-1B (Arts): - Requires distinction and recognition above the norm. 3. O-1B (Motion Picture and Television): - Requires a record of extraordinary achievement. Eligibility: - Employer/Agent must submit Form I-129 and evidence of a major award or at least three alternative forms of documentation (e.g., publications, judging roles, contributions, high salary). - Evidence is assessed collectively to determine if the extraordinary ability or achievement standard is met. Labor tightens further batch of student visa policy News Summary - The Albanese Government in Australia is implementing further changes to student visa policies in response to the Nixon Report on visa integrity. These changes aim to target scams and abuse in the system. The new policies include building risk indicators across the international education system, increasing monitoring of student attendance, preventing cross-ownership of colleges between providers and education agents, prohibiting agent commissions on student transfers, and providing greater access to agent performance data for providers. These changes are expected to lead to a decline in student numbers and a decrease in onshore and offshore student visa applications. The goal is to attract high-quality students who will contribute to Australia's workforce in areas of need. Read More
