One of the advantages of arbitration is being able to chose a highly specialised individual to decide the dispute which arises - allowing the tribunal to have direct experience of a particular industry or problem, rather than automatically assuming a lawyer is best placed to suit the mess out. However, chosing an industry expert who does not have a solid background in arbitration practice, particularly as a sole arbitrator, can lead to disastorous missteps, despite the best of intentions. IBA Paris 2023-Among the great number of challenging new topics that are relevant to white collar crime practice, the connections between arbitration proceedings and criminal proceedings are getting increasing attention. A great panel addressed the issue from the standpoint of several jurisdictions, analyzing substantial and procedural implications. For those interested, next year in São Paulo, at the end of January-beginning of February, a whole conference will have as an object “when arbitration meets crime”.
