The article focuses on the legal position in Singapore, United Kingdom and India and analyses the approach adopted by courts in these jurisdictions when faced with winding up and/or insolvency proceedings pending arbitration. The article compares the commonalities of the approach in the three jurisdictions and concludes by emphasizing issues that remain unclear and require consideration. The article finally calls for an international consensus for streamlining the interplay between arbitration and insolvency laws to promote efficiency in international business and advance the objective of the UNCITRAL Model Law on International Commercial Arbitration.
