0:17 Mr be can I explain that um uh one of our assessors is uh joined 0:27 in remotely this morning and I understand that before we begin hearing 0:34 evidence you wish to raise the issue of disclosure yes um it's a matter of 0:42 importance that I wanted to update you and uh the core participants on before 0:48 we call Mr Bates to give his oral evidence and commence the substance of the hearings in phases um five and six 0:57 the core participants were sent an email by the solicitor to the inquiry yesterday that contained relevant 1:04 correspondents from the post office uh that um dates between the 28th of March 1:10 and the 5th of April sent to the inquiry that consists of nine 1:16 letters I would propose to give you a brief background before moving to the current issue I'm going to try and keep 1:23 it as succinct as possible but I also think that putting the issue the current issue in context May assist you 1:31 so you'll recall that the post office's late and problematic disclosure of 1:36 documents has been a constant theme in this inquiry resulting in you ordering 1:42 that we hear oral evidence from the post office and it's inquiry representatives 1:47 in two disclosure related hearings held in July and September last year on the 1:53 12th of January this year the inquiry held a further hearing on disclosure and called post offices recognized legal 2:01 representative Mr Jackson of Burg salmon LLP to give oral evidence you will 2:08 recall that by and large the key issue that was discussed at that hearing was how the post office had discovered a 2:15 further post office repository or data source known as Microsoft Exchange 2:23 365 you'll recall that the Microsoft Exchange 365 um uh repository 2:30 was brought to the inquiry's attention during the phase four hearings and as a 2:35 result the inquiry received numerous sometimes voluminous last minute disclosure of documents said to relate 2:43 to phase four Witnesses on some occasions only days before some witnesses were due to give their 2:49 evidence during the January hearing Mr Jackson Jackson said that such last minute Disclosure by the post office 2:56 during the phase four hearings had been quote subop optimal those late disclosures had put 3:03 immense pressure on the inquiry Council and solicitor teams who worked extremely hard to ensure that the phase four 3:10 hearings could in fact continue as planned in some instances regrettably a 3:16 decision was made to postpone or reschedule a witness at short notice including you'll remember Mr Jenkins and 3:22 Mr Longman both of whom the inquiry has now scheduled to hear during phases five 3:28 and six whilst other matters were discussed at the hearing held on the n on the 12th of January the focus was on https://lnkd.in/e3eeWE4M
