This week’s highlights are now available from the LexisNexis UK IP team. We have analysis of an interesting judgment in which the High Court was asked to issue a preliminary ruling as to which product features were being compared in comparative advertisements for veterinary nutraceutical products (Gibraltar v Viovet). We also have the latest on new EU rules for geographical indications covering agricultural products, wines and spirit drinks, which come into force on 13 May 2024: https://lnkd.in/eW4JngDP (subscription required) #ip #comparativeadvertising #trademarks #geographicalindications #lexisnexis

It’s crucial we know the facts when discussing the safety and registration of #cropprotection products like #glyphosate. Fortunately, Australia has a regulatory system based on independent risk-based assessment of scientific data. The responsibility of approval and regulation of #cropprotection products used in Australia lies with the Australian Pesticides and Veterinary Medicines Authority (APVMA). the APVMA is a science-based regulator that is independent of government, industry and other advocacy groups. Unlike in Europe where risk assessment also needs to be approved by a political process, this independent approach ensures the assessment of #cropprotection products used in Australia is based only on what science says about the safety of the product and nothing else. Mr. Ken Matthews, AO made 33 recommendations to Senator Murray Watt, Minister of Agriculture on the future structure and governance arrangements for the APVMA [https://lnkd.in/gdjvbKd7]: Interestingly, the ‘GPO’, was created to support the desire to relocate the APVMA HQ to Mr Joyce’s constituency. The ‘GPO’ on the Location of corporate Commonwealth entities stipulated: (1) It is a policy of the Australian Government that a corporate Commonwealth entity with agricultural policy or regulatory responsibilities is to be located: (a) in a regional community; and (b) within 10 kilometres by road of the main campus of a regional university that is recognised for research and teaching in the field of agricultural science. (2) In this section: regional community means a community that is not within 150 kilometres by road of Canberra or the capital city of a State [https://lnkd.in/gtMQ5Mbv]]. If anyone looks at the map of Australia to solve the abovementioned ‘GPO’ puzzle then they should not be surprised - the only city in Australia that satisfies the ‘GPO’ is ARMIDALE in NSW. Now 5 out of 33 recommendations of Mr Matthews are linked to this ‘GPO’: * Headquarters in Canberra * Transfer to Canberra * Transition and relocation plan * Funding for a relocation package * Revoke the GPO The interesting aspect is that Senator Murray Watt, Minister of Agriculture appears to agree with Mr Joyce on retaining the GPO. Regarding the following recommendations: * National Registration Authority (NRA) changed to the Australian Pesticides and Veterinary Medicines Authority (APVMA) now Mr Metthews is recommending the APVMA become the Australian Pesticides and Veterinary Medicines Regulator (APVMR). * Revoke the Location of Corporate Commonwealth Entities Order 2016 (the ‘GPO’). * One of the major recommendations is to approve an appropriation-funded relocation package with the relocation of the HQ to Canberra and Armidale to remain a remote office. On 17 April 2023, ABC reported first time after a long time that Senator Murray Watt, Minister of Agriculture, David Littleproud, Maranoa MP (Leader of National Party), and Barnaby Joyce, New England MP from major political parties agreed to say NO to the relocation of the APVMA back to Canberra [https://lnkd.in/gKRnW3sW].

Leadership would involve addressing why scientific stakeholder input did not feature in Mr Matthews first review of APVMA. See Consensus Statement of civil society groups. https://lnkd.in/grBaEkaN And would address why APVMA has failed to slow flow of pesticides onto GBR and into rivers across Australia. Leadership would address why the endocrine disrupting effects and other externalities of pesticides do not weigh on APVMA assessments. Happy to help Minister Watt. Thanks for your pre-briefing. There is much to do. Much more than deciding the location of APVMA. The big issue is one of the function of regulator. This cannot be gamed through distorting meanings of words. It requires earnest, methodical, transparent application of science to protect human health and environment from toxic exposures that are increasing. This is not currently being done. If it were, tens, if not hundreds of products would be removed from use overnight. Thousands of endocrinologists are not wrong. Pesticides are an existential threat to human health.
Today I announced the Australian Pesticides and Veterinary Medicines Authority will remain in Armidale & independent of government, in response to a review of serious allegations of poor regulatory and workplace culture. The chaos that followed Barnaby Joyce’s forced relocation of the APVMA is over. The APVMA team plays a vital role approving & reviewing ag/vet chemicals & medicines so our farmers have the latest technology & so our food & fibre is safe. We will continue to take decisive action to build a better, stronger APVMA. You can read the review and preliminary response here: https://lnkd.in/gwEFUtgQ

New article: Changes to GDP rules for veterinary medicinal products (https://lnkd.in/e34-bYHh). From 1 September 2024, the Rules of Good Distribution Practice within the Eurasian Economic Union, approved by the Resolution of the Council of the Eurasian Economic Commission dated 3 November 2016 No. 80 (EAEU GDP Rules) will also apply to medicinal products for veterinary use. The EAEU GDP Rules almost completely replicate the structure of the European standard Guidelines of 5 November 2013 on Good Distribution Practice of medicinal products for human use (2013/C 343/01).
