What if I take the children out of Canada—can anyone catch me? If a parent wrongfully takes the children out of Canada, there are legal mechanisms in place to address this. The Hague Convention on the Civil Aspects of International Child Abduction governs such situations. This convention, which includes signatory countries like Canada, the USA, Australia, the UK, and South Africa, provides for the return of children to their habitual residence if they have been wrongfully removed. Additionally, the statute provides for the extradition of the abducting parent back to Canada and even allows for the prosecution of such parent for child abduction.
