The best way to avoid federal litigation? Have your project not be subject to federal jurisdiction! Today's marvelous ruling by 5th Circuit Judge Edith Jones, as a follow-on to this year's Sackett Supreme Court case, is the first of (hopefully) many lower court rulings that will bring common sense (and state, rather than federal oversight) back to wetlands jurisdictional determinations! This type of ruling will ultimately apply to not just 404 (dredge and fill) permits, but to 402 (NPDES) permits as well! Huge news for responsible resource development in Alaska! #TGDL
