Labor & Employment attorney Salvatore Gangemi recently wrote a blog post on the Connecticut Supreme Court’s August 1st decision in O’Reggio v. Commission on Human Rights and Opportunities, et al., to adopt the federal Title VII standard for determining who is a “supervisor” under the Connecticut Fair Employment Practice Act (CFEPA). Consequently, according to O’Reggio, in the case of a hostile work environment, an employer is vicariously liable for the acts of a harasser if the harasser has the power to take tangible employment actions. It was introduced as a solution to impasses in collective bargaining negotiations between public sector unions and government employers, where prolonged strikes or lockouts were not feasible due to the essential nature of public services. The concept was first applied in New Jersey, where it became part of the state's Public Employment Relations Act of 1974. The idea was to create a more efficient and fair arbitration process that would motivate both parties to make reasonable offers, thereby reducing the likelihood of extreme positions and fostering more amicable resolutions.
