👮♂️📦 The European Business Association reminds that starting from July 1, 2024, Law 5313-IX introduces criminal liability for smuggling all goods. The law was adopted with some amendments insisted upon by the business community. Details: https://lnkd.in/dgEfdt-N ✍️ Thanks to the efforts of the EBA during the work on this initiative, criminal liability for unintentional errors in declarations was canceled, and the threshold values for the cost of violations for applying criminal liability were significantly increased. We expect news and feedback from the business community from July 1 regarding the introduction of the new legislative changes and will closely monitor any cases of increased pressure on businesses.

In October 2023, the Economic Crime and Transparency Act 2023 (ECCTA) passed into law. This is not only a major company law reform but also the biggest shake-up in the history of Companies House. Implementation of the measures prescribed under ECCTA will be staggered and are dependent on secondary legislation having been implemented. These orders entail a penalty but no prosecution, easing the load on the judicial system and freeing up companies to focus on their business.” “Over 2019 and 2020, the government decriminalized over four dozen violations for faster adjudication of corporate defaults and lapses. These cases are now decided upon by RoCs under the ministry of corporate affairs (MCA), which are run by officers of the Indian Corporate Law Service (ICLS).
