🍽️ Lunch & Learn: Understanding Leases vs. Sub-Leases! 📚 🏠 Lease A lease is a contract between a landlord and a tenant that grants the tenant the right to use the property for a specified period in exchange for rent. Here are some key points: Primary Agreement: The lease is a direct agreement between the landlord (lessor) and the tenant (lessee). Full Responsibility: The tenant is fully responsible for the lease terms, including rent payment and adherence to all clauses. Fixed Term: Leases typically have a fixed term (e.g., one year) and are renewable under mutual agreement. Control and Use: The tenant has the primary right to use the property and its amenities according to the lease terms. Security Deposits and Rent: Rent is paid directly to the landlord, and the landlord typically manages any security deposit. 🏘️ Sub-Lease A sublease occurs when a tenant already holds a lease for a property and rents out a portion or all of the property to another party. Key points to understand: Secondary Agreement: A sub-lease is an agreement between the original tenant (sub-lessor) and a new tenant (sub-lessee), while the original tenant remains bound by the terms of the primary lease. Shared Responsibility: The sub-lessor remains responsible for the lease, including rent payment to the landlord, while the sub-lessee pays rent to the sub-lessor. Term Flexibility: The sub-lease can be for a portion of the remaining lease term and may offer more duration flexibility. Partial Control: The sub-lessee uses the property but does not have full rights as the original tenant and must follow the rules set by both the original lease and the sub-lease agreement.
