USCIS H-1B Cap FY 2025 Update! In March, USCIS conducted an initial random selection for the fiscal year 2025 H-1B cap. This included beneficiaries eligible for the advanced degree exemption. The filing period for those with selected registrations was from April 1 through June 30, 2024. New Round of Selections! To meet the FY 2025 regular cap numerical allocation, USCIS will conduct an additional selection for unique beneficiaries from previously submitted electronic registrations. Notifications for this second round will be sent soon. Note: There's no second selection for the master's cap as sufficient registrations were already selected. Those selected will have their USCIS online accounts updated with a selection notice, including filing details. 📢 FY 2025 Cap Initial Registration Period Announced! The initial registration period for the Fiscal Year (FY) 2025 H-1B cap is set to commence. Mark your calendars for these important dates: 🗓️ Registration Opens: March 6, 2024, at 12:00 PM Eastern Time 🗓️ Registration Closes: March 22, 2024, at 12:00 PM Eastern Time During this window, prospective petitioners, along with their representatives (if applicable), are required to register their beneficiaries through the USCIS online account system. 💰 Remember, there is an associated registration fee of $10 for each beneficiary, which must be paid during this period. A new edition of Form I-129 with the H-1B Registration final rule and Fee Schedule final rule changes will soon be available to preview on uscis.gov (edition date 04/01/24). On April 1, 2024, only the 04/01/24 edition of Form I-129 will be accepted. As a reminder, USCIS recently announced a final rule that will increase the filing fee for Form I-907, to adjust for inflation, effective Feb. 26, 2024. If USCIS receives a Form I-907 postmarked on or after Feb. 26, 2024, with the incorrect filing fee, USCIS will reject the Form I-907 and return the filing fee. For filings sent by commercial courier (such as UPS, FedEx, and DHL), the postmark date is the date reflected on the courier receipt. #h1bvisa #h1bcap #h1filing #h1b2025

USCIS has issued a final rule regarding fee increases that will take effect on April 1, 2024. This is separate from the increase in premium processing fees that takes effect on February 26, 2024. While USCIS has provided incentives to file cases online through myUSCIS accounts; they have not made those accounts available to attorneys in some instances, or easily accessible in others. While I'm not optimistic, hopefully these fees will fund a better system for online filings that the Service so clearly wants. #uscis #immigrationlawyer #immigration

There will be a new form edition for each form affected by the fee rule that goes into effect on April 1, 2024. USCIS will use the postmark date of a filing to determine which form version and fees are correct but will use the receipt date for purposes of any regulatory or statutory filing deadlines. H-1B Initial Electronic Registration Selection Process Completed U.S. Citizenship and Immigration Services has received enough electronic registrations for unique beneficiaries during the initial registration period to reach the fiscal year (FY) 2025 H-1B numerical allocations (H-1B cap), including the advanced degree exemption (master’s cap). We have randomly selected enough properly submitted registrations for unique beneficiaries projected as needed to reach the H-1B cap and have notified all prospective petitioners with selected beneficiaries that they are eligible to file an H-1B cap-subject petition for such beneficiaries. Registrants’ online accounts will now show one of the following statuses for each registration (that is, for each beneficiary registered): Submitted: The registration has been submitted and is eligible for selection. If the initial selection process has been completed, this registration remains eligible, unless subsequently invalidated, for selection in any subsequent selections for the fiscal year for which it was submitted. Selected: Selected to file an H-1B cap petition. Not Selected: Not eligible to file an H-1B cap petition based on this registration. Denied – duplicate registration: Multiple registrations were submitted by or on behalf of the same registrant for the same beneficiary. If denied as a duplicate registration, all registrations submitted by or on behalf of the same registrant for this beneficiary for the fiscal year are invalid. Invalidated – failed payment: A registration was submitted but the payment method was declined, not reconciled, or otherwise invalid. Deleted: The submitted registration has been deleted and is no longer eligible for selection. Processing submission: USCIS is processing your submission. It may take up to 72 hours for all of your case information to show on the case details page. While it is processing, you will be unable to access your draft.
