It's been a busy year-end for #ESMA and, as a consequence, the rest of us! ESMA's second consultation on Techinal Standards specifying certain requirements of Markets in Crypto Assets Regulation (#mica) presented a lot of questions bearing on the structure of the crypto assets environment in Europe. Much presented challenging and thoughtful questions on how to deal with sustainability, trading and other important factors. The Association of Global Custodians European Committee responded focusing mainly on two aspects affecting CASPs. In our view, certain approaches taken today in the TradFi post-trade world should carry over to CASPs who perform similar functions under the MiCA regime, i.e., those that do not operate trading platforms. The attached letter to ESMA provides an overview of the approach that we recommend. There is no doubt we will see much more on this topic in 2024 ... in the meantime, I hope everyone has a lovely and restful holiday period.
