I was surprised to see that the new edition of the European Patent Guide – How to get … (updated to 1 July 2023) has fully removed the possibility to use fax to file an application (4.3.003), an opposition (5.5.003), a request for limitation (5.6.002), an appeal (5.7.004) etc., as well as the the fax numbers in Annex III. Thereby, the Guide indicates -or at least strongly suggests- that fax can no longer be used. However, on the 1 July 2023 -as well as still today- fax is still available for parties for almost any act. The EPO itself has stopped to send faxes per 1 march 2023, but has not (!) stopped not to receive them. I refer to OJ EPO 2023, A15 (“The present notice does not affect the filing of applications and other documents by fax, which remains available under the conditions defined by the President of the EPO. Anticipating future digital developments, the EPO has however started reflecting on the future of fax filings and will engage in discussions on this matter with stakeholders.”) and OJ EPO 2019, A18, Decision of the President of the European Patent Office dated 20 February 2019 concerning the filing of patent applications and other documents by facsimile - which has not (yet) been superseded by any later decision.
