When amending a pleading, written consent from opposing counsel is sufficient; neither a motion for leave to amend, hearing, nor court order is required IF the opposing party consents to your proposed amendment. Note that the second sentence of Rule 1.190(a), Fla.R.Civ.P., states that “a party may amend a pleading only by leave of court 𝐨𝐫 𝐛𝐲 𝐰𝐫𝐢𝐭𝐭𝐞𝐧 𝐜𝐨𝐧𝐬𝐞𝐧𝐭 𝐨𝐟 𝐭𝐡𝐞 𝐚𝐝𝐯𝐞𝐫𝐬𝐞 𝐩𝐚𝐫𝐭𝐲.” So, if you wish to amend your complaint or answer after the “free” amendment allowed by Rule 1.190(a)(i.e., before a responsive pleading is filed or within 20 days thereafter), written consent from the opposing party’s counsel is all that you need.   Like what you see? FLORIDA GOVERNOR SIGNS NEW LAW SQUASHING SQUATTERS’ RIGHTS https://bit.ly/3TJQJx5 In late March, Florida Governor Ron DeSantis signed legislation that makes it easier to remove squatters—which, as we have seen, is a growing problem across the nation. According to WPTV, under the new law, a property owner can request law enforcement to immediately remove a squatter if the person has unlawfully entered, has refused to leave after being told by the homeowner to do so and is not a current or former tenant in a legal dispute.
