Monday post = post from the ❤️ Do you take time to step back and ask yourself what you like most about your job? I love #expert proceedings (though being in Court will always remain my favorite). Expert proceedings are ordered by French Courts in #product liability cases. The goal is to have an independent expert determine the origin and root cause of an incident / accident. So it’s technical / scientific. No debate on the law right? As a matter of principle, true. But lawyers have a key role to play: 👉🏽 Ensure that his/her client’s voice is heard 👉🏽 Ensure that the Judicial Expert does not characterize anything with legal concepts 👉🏽 Ensure that the adversarial principle is complied with 👉🏽 Understand! Because later on, as lawyers, we will be the ones to explain the technical aspects to the Judge I ❤️ this part of the case. You get to meet engineers, experts from all fields. In the below picture, we work with metallurgy & engine design experts for instance. In other cases, I get to work with battery, chemical, steel, construction, hydrocarbons, turbine, new energy experts. Just fascinating. You also get to travel wherever the products are in the world.🌎 What this practice thought me as well? You need to be curious, open-minded and rigorous. All what makes a great scientist - and in fact a great lawyer. So take time to think about what you like in your job. Just writing this brought a smile on my face, remembering all the anecdotes I have about Expert meetings and how fun they can be.

📢 👨⚖️ Case Law Alert!!! The case of M obo M.M v Imerys Refractory Minerals SA (Pty) Ltd centres on a critical legal dispute that emphasises the #responsibilities and #liabilities of #mining operators in ensuring environmental, health, and safety (EHS) #compliance in their operations. In this case, the plaintiff, representing her minor child, has brought forth a claim against the defendant, Imerys Refractory Minerals SA (Pty) Ltd., an operator of an open-cast mine in Ga-Malepe village. The heart of the matter lies in an #incident in which the plaintiff's minor child suffered #injuries when he #slippedandfell into a disused mining pit. Although the defendant had ceased mining in this area, the plaintiff alleged that the defendant #failed to #restore and #rehabilitate the mined area, thereby creating a #hazardous space that posed #risks to the public and animals. Consequently, the plaintiff is seeking #damages, alleging that the defendant has a #duty to secure and maintain the area for the #safety of the public. This analysis explores the proceedings and judgment, examining the significance of EHS regulations, the court's analysis of the defendant's actions, and broader implications for mining compliance and public safety.
