A number of #landlords, will continue to be able to serve #section21 for considerable period of time after the Renters Reform Bill becomes law. Ryan Heaven of Dutton Gregory Solicitors explained in a Goodlord webinar, transition measures will be in place for existing tenancies and duel system will continue until these are run off, in the prescribed time for each type of tenancy. South Carolina tenants are at the highest risk of eviction out of any other state in the nation, and our state also has one of the country’s highest rates of eviction filings. These facts can be traced back to several issues in law and policy, but a major concern in housing justice is the cost of filing for evictions. On average, it costs a landlord around $100 to file an eviction in the U.S., but in South Carolina, landlords only have to pay $40. This means landlords don’t have to consider a higher cost burden when deciding whether or not they want to pursue an eviction. Unlike other states in the country, South Carolina doesn’t guarantee legal representation in eviction proceedings. This means low-income folks faced with eviction are often forced to navigate complex legal proceedings without the institutional knowledge counsel could provide. Once someone has been evicted, it stays on their housing record for the rest of their life. Landlords can easily access any applicant’s housing record through the tenant screening portion of a rental application and deny a potential tenant because of a past eviction. This “Scarlet E” makes it extremely difficult - even impossible - for people to find stable housing if they’ve been evicted. Something to think about: It's not just about getting compensated for bad-faith rental practices. We are talking about a person's home, sense of safety and security, the impact on their friendships and connections with neighbours, the unexpected time and costs required to find new housing, the health implications of stress, social upheaval and removal of informal social supports, etc. Protections that involve compensating people after the fact misses the point. This is indicative about how we *think* about housing, often as a profit-making business, where decisions are of course made based on a landlord's bottom line and protecting their investment. This is not a dig at landlords, many (most) I know are amazing and want to do good. But this is systems level stuff again: If we *think* about housing as a business, then humanitarian policies and laws are really hard to put in place. If we *think* about housing as a human right, with a whole lot of meanings beyond the most basic understanding as shelter, we start to question how housing could ever be considered a business in the first place. That's where my mind goes anyways.

Two Agenda Items That Put Housing Under Attack Item #5: See the proposal for a Tenant Anti-Harassment Ordinance here.  California state law already has powerful protections that make it illegal to harass a tenant. This proposal would create a private right of action, which creates enormous liability for housing providers. "Mom & Pop" housing providers in Sacramento are usually the ones that offer single family rentals that provide housing for families, without them families will be forced into smaller less ideal housing accommodations. Why this policy proposal hurts housing and homeownership in Sacramento: •      "Sacramento Opportunity to Purchase Act" that would require any tenant-occupied building that is listed for sale to be sold to a tenant or eligible community group if they can meet the initial listing price. •        This is an extremely flawed policy that creates delays and significantly interferes in the market, home values, and impact a property owner's time-sensitive decision to sell based on personal costs related to education, health care, and major personal expenses. •        Tenant and Community Opportunity to Purchase policies require the city to create a costly administrative process.

Unfortunately, last week the city of Boise city council took unprecedented steps to pass final city ordinances restrictions on landlords. NARPM did its best to negotiate with the city of Boise in good faith on coming up with reasonable tenant protections that would help our community. Instead, the city has moved forward with their restrictions on private businesses. These restrictions include threatening private businesses and their employees with criminal misdemeanors if private businesses do not enter into contractual agreement with 3rd party organizations. These contractual agreements provided no recourse for private businesses to negotiate or decline provisions of these contracts. NARPM members are directed by strict professional and ethical guidelines. These principals that our members abide by compel our members to stay in good standing with all local and federal laws landlord tenant laws. Despite our commitment to follow the law, additional avenues are available to our membership regarding these over-reaching rules put forth by the city.
