As Dr. King observed, placing our faith in the humanity of others often leads to chastisement and disillusionment. It tests our own motives and humanity. It places us in a hard place, realizing we cannot do it alone while accepting we must work as though we are. Any meaningful change in the world around us will always be based in deep personal change. It is the type of change that does not consider the behavior of others when deciding our own. It is one that painfully brings an increased awareness of our flaws and weaknesses, and slowly but definitively transforms us into better people. For centuries we have focused on technological innovation but have not devoted the same attention and energy to social innovation. We have focused on making better THINGS but not on making better HUMANS. In fact, many of our technological innovations get in the way of social innovations. We abound in business and technological entrepreneurs but have a deficit of social entrepreneurs. It is far better to be a good human than it is to be a good worker/professional (although it doesn’t pay as well). It is also much easier to be a good worker/professional than it is to be a good person. I felt that white ministers would take our cause to the white power structures. I ended up, of course, chastened and disillusioned." - Martin Luther King Jr. You might think this post is about race. It's not. Actually, throughout the entire North Carolina Justice for All Project (www.ncjfap.org) campaign for proposing limited licensing of another tier of legal professionals and other types of regulatory reform to address the civil access to justice crisis, we have consistently emphasized that this issue is not fundamentally centered around race (or my preferred phrase: people groups). The civil access to justice crisis is fundamentally about money. If you lack the financial means to secure a lawyer when you need one, and you lack legal prowess, you won't have a shot at equal access to justice. So, regardless of your skin's position on the spectrum of melanin, if you find yourself in a legal dispute that affects vital aspects of your life such as housing, healthcare, safety, economic stability, or family structure, and you have limited financial resources, the reality is that you will face significant barriers. ✨ Still, MLK's words resonate as I consider the resistance some lawyers have against innovative solutions in pursuit of comprehensive access to justice. I, too, used to believe that advocating for regulatory reform within the legal profession to enable community justice workers, allied legal professionals, and individuals beyond traditional lawyers to offer assistance to those in need was a straightforward matter. If we could only reach decision-makers, they would recognize not just the importance but the absolute necessity of this change in our society. I, too, have ended up chastened and disillusioned - but I will not give up. Lawyers who resist such progressive solutions should ponder the implications of their inaction or opposition. MLK's experience teaches us that folding their hands and looking away won't resolve the access to justice crisis. Instead, it perpetuates inequality and injustice, undermining the principles of a fair and equitable society. It says: "I won't assist you because you can't afford my services, but I also won't permit anyone else to assist you." Again, this isn't about race. It isn't about being a good lawyer. It's not about protecting turf. It's certainly not about public harm. The public has overwhelmingly stated they support regulatory reform of the legal profession. This is about being a good human. It's about ensuring people have a fair shot to have their concerns heard. Unfortunately, that's a near impossibility, when you cannot afford a lawyer to articulate your concerns in a format the courts or other agencies and tribunals will accept. #AccessToJustice #LegalReform 🌐⚖️

I’m pleased to announce that effective April 1st, 2024 I became an associate counsel of macushlaw, a firm based in Vancouver, as part of a phased plan for my retirement from legal practice. I will be associate counsel with macushlaw for the next few months, to assist during the transition and ensure that client needs are met in a timely manner, particularly for current/ongoing matters. I’m now 67, and have been practicing in this field since 1995. But there comes a time for all things, including retirement. macushlaw has a practice that is compatible with mine, and offered to take on my practice. They also have the capacity to provide additional services. Most importantly, there will be a planned transition, where all willing clients have a suitable new home. It seems the prudent thing to do. The beginning of my retirement has meant moving to Squamish, where some of my family live, and numerous friends. I plan to finish a history of climbing in southwest B.C., in particular rock climbing at and near Squamish, which I’ve been working on for some time. And should have more time for outdoor activities, and maintaining volunteer commitments. Although first I’ll be going to Government House in Victoria for a ceremony on April 24th, as in December I was appointed a King’s Counsel. I was also there in 2022 for the B.C. Community Achievement Foundation Community Award, but hopefully that doesn’t make me a repeat offender. I was perhaps the first lawyer in B.C. to specialize in legal and governance advice to not-for-profit organizations, although many lawyers and firms provided and now provide such services as part of their practices. Society and charity law has slowly become a recognized field within the Canadian legal profession, and it has been a pleasurable challenge to work in it. I’ve met and had many interesting and varied clients, all of whom in their various ways try to make our country and world a better place.

The appointment of a single “designated contrarian” will not improve the effectiveness of a Board. A strong Board culture...in the for- and non-profit sectors...that facilitates its oversight, advisory, and growth- and impact-support roles bypasses that need. Instead, to maximize Board effectiveness and protect the organization, its donors, partners, and constituents, Board culture should be driven by the following maxims: 1) The Board culture should facilitate and encourage openness, questions, candor, debate, fresh ideas, and alternate perspectives. There are always opportunity costs and pros and cons—explore them. 2) Each Board member should feel comfortable, safe, and valued when raising a contrarian viewpoint or alternate perspective. Managing that debate is the role of Board leadership. 3) There should be a clear mission and culture articulated for the Board itself, instilled during recruitment, new member on-boarding, as well as annual reminders during Board retreats. 4) The Board must espouse a zero-tolerance policy regarding corruption, power-mongering, bullying, cliques, cronyism, malfeasance, and extended non-engagement. 4) Board members need to stay in their lane, supporting the team excuting the organizition’s mission through expertise, advice, contacts, and fundraising…not micromanagement. 5) There should be no sacred cows…ever…be they policies, programs, or people…including Board members who neither uphold the Board’s integrity and seriousness of purpose or advance its mission through active participation. I have quickly resigned non-profit Boards where I found a weak culture, the above rules ignored, or where I felt members were using their Board position exclusively as a resume builder rather than an impact-generator.
