It wasn’t too long ago that I wrote a post on #vicarioustrauma and what I had observed in The Jury: Murder Trial on Channel 4 Juror appreciation week is coming up and the British Psycholgical Society is urging the Government to put in place support for jurors who are at risk of #vicarioustrauma. About time! Now how about the rest of the #courtstaff #lawyers and those who make #Truecrime….?! In these areas of work, there is always going to be material that is far beyond what one ever imagines having to see. What is seen can’t be unseen. If there are aspects of evidence that resonate personally, the impact can be far greater. The BPS is concerned that jurors who are exposed to distressing evidence, sometimes over several months, are particularly at risk. Jurors can potentially go without psychological support throughout a case and can be ‘dropped’ at the end of their service, with no support available. The warning comes ahead of the first ever Jury Duty Appreciation Week (6-10 May), designed to highlight the ‘unsung heroes’ of the justice system, which the BPS is proudly supporting. Dr Roman Raczka, President-Elect of the BPS, said: “It’s important to remember that jurors are members of the public who have been required to join court processes from their everyday lives, and who can potentially be exposed to material far beyond what they are used to seeing." Today, I experienced a moment in court that both intrigued and perplexed me. As an advocate dedicated to the pursuit of justice, every court encounter offers valuable insights, but this one was particularly thought-provoking. Three months ago, I filed a case which, after following the due process, turned ex parte. The hearing was scheduled for today, intended for final arguments before reserving for orders. In an unexpected turn, the Honorable Judge made a peculiar request. Given that this case was relatively new (filed in 2023), the judge suggested an adjournment for two additional dates. The rationale was striking: he was currently addressing cases from 2018, and advancing a 2023 file could potentially invite undue scrutiny. My client, present in court, had no objections to this request. Respecting the judicial process and understanding the unique circumstances, we sought adjournment as instructed. This incident raises significant questions about our legal system. Are we, inadvertently, creating a system that casts doubt on the expeditious disposal of cases? Moreover, it highlights concerns about the image of our judiciary. Efficiency is key, but when quick resolutions become grounds for scrutiny, it points to deeper systemic issues. I am curious to know your views. Have we reached a point where the speedy resolution of legal matters is viewed with suspicion? With expansion of the judicial roles open to Chartered Institute of Legal Executives and what seems to be an obvious expansion of rights to Costs Lawyers to be eligible for judicial roles, here is hoping that CITMA and CIPA (with the assistance of IPREG) are able to prepare a similar case for their members..

A lawyer's profession is meant to be a divine or sacred profession by all means. In every profession, there are certain professional ethics that need to be followed by every person who is into such a profession. But there is the fact that professional misconduct is a common aspect, not only in other professions but in advocacy also. Misconduct has been defined in Black's Dictionary as, the transgression of some established and definite rule of action, a forbidden act, a dereliction of duty , unlawful behaviour, improper or wrong behavior.
