Today, the Supreme Court preserved women’s access to a vital form of health care, maintaining full access to the medication abortion pill mifepristone. As a reminder of the stakes: A group of anti-abortion doctors originally sought to remove the drug from the market entirely — overturning the agency’s 2000 decision to approve it — and the court had pared back the case to consider only more recent FDA regulatory changes to how the drug is dispensed. That had put at risk the ability to be prescribed medication abortion through telehealth and receive the pills through the mail--a service that had significantly improved access--as well as the ability for nurse practioners and physician assistants (rather than only doctors) to prescribe the drug. While it's good news that the case was dismissed, it’s important to remember that the decision was based on reasonably technical grounds — SCOTUS decided that the plaintiffs in the case, a group of anti-abortion doctors, had not actually been harmed by the FDA’s mifepristone regulations and thus lacked standing to sue. You can bet that conservative groups are already looking for new plaintiffs and inventing new, similarly specious legal arguments to restrict access to mifepristone. Providing medication abortion based only on a self-administered, programmed questionnaire is likely to be effective, safe, efficient, and acceptable, according to the findings from our latest study performed at Planned Parenthood North Central States & Planned Parenthood of the Rocky Mountains. The study enrolled people in Colorado and Minnesota who submitted online questionnaires indicating eligibility for medication abortion.
