Creinen 2020, a study purported to show Abortion Pill Reversal therapy as unsafe, in fact does the opposite. While small, the study showed that the abortion pill mifepristone, when taken alone, not only resulted in fetal death but also in increased maternal hemorrhage. Mifepristone's mechanism of action is to slough the uterine lining. When mifepristone was followed by progesterone (as abortion pill reversal therapy), fetal life was saved in most cases and maternal hemorrhage protected against. Progesterone's mechanism is to maintain the uterine lining. Can states ban emergency abortions when it's necessary to preserve the health of the patient? The Supreme Court might not answer this question this term - which will result in different rules across the country. SCOTUS accidentally posted a draft decision in the Idaho case this morning (June 26th). If this draft is the final ruling the Court will have taken two abortion cases this term- but not ruled on the merits in either case ahead of the 2024 presidential election. If this ruling is issued- pregnant patients in Idaho may be able to get emergency abortion care to stabilize their health. But patients in the 5 other states that have abortion bans without health exceptions will not be able to obtain this care while the litigation proceeds through the courts again. SCOTUS will likely hear this case from Idaho again in a future term or review the case from Texas presenting the same question whether the federal Emergency Medical Treatment and Labor Act (EMTALA) preempts state abortion bans with no exception to preserve the health of the pregnant patient. The Supreme Court just announced they are going to take a case about mifepristone, one of the pills involved in medication abortion, this term. This means they will rule on whether or not to limit access to a safe and effective, decades-long FDA-approved medication, but for now, nothing changes.
