In a brand name or equal procurement, the Agency cannot evaluate on salient characteristics of an equivalent product that were not announced to offerors. In American Material Handling’s (AMH) recent protest, the Agency sought to procure a Caterpillar 980 wheel loader or an equal product. Award would be made the the lowest priced technically acceptable offeror. The RFP included a two-page specification sheet and informed offerors that the offered wheel loader had to meet or exceed the “specifications attached”. AMH confirmed with the agency that equivalent products would be considered, and submitted a proposal to provide a Volvo wheel loader that met or exceeded the attached specifications. During the evaluation, AMH was evaluated as the lowest priced bidder but the Agency awarded to Caterpillar because it concluded that AMH’s wheel loader did not meet six “salient characteristics” that had not been announced in the RFP. GAO sustained AMH’s protest and rejected the Agency’s argument that all characteristics of the Caterpillar 980 wheel loader were incorporated by reference and were easy to discover on the internet. GAO reiterated its basic rules that offerors must be informed of the basis upon which proposals will be evaluated, and once announced, the Agency must adhere to the announced evaluation criteria. In particular, a brand name or equal procurement must inform offerors of the essential characteristics that will result in a product being considered “equal.” GAO also noted that in advancing this argument, the Agency had also found that AMH’s wheel loader did not meet ten other characteristics of the Caterpillar 980, but those were not determined salient. GAO felt that this showed that the agency decided what characteristics it would consider salient during the evaluation rather than transparently conveying the requirements in the solicitation. In a brand name or equal procurement, an agency’s failure to adhere to the announced characteristics can result in a sustained protest. To the extent that there is any question about which characteristics are salient, however, those should be clarified through the question and answer process or a pre-award protest. #governmentcontracting #govcon #bidprotests #smallbusiness

Too what extend it’s possible to analyze if the vendor is strategically fit? ▪ Sourcing and Operation Management ▪ Strategic planning played a crucial role in our decision-making process when we were looking to procure new Semi-Automatic MIG welding machines for our factory. After thorough research and evaluation, we decided to purchase 2 machines from an authorized dealer who promised advanced technology and reliable European Origin. The initial document submission and vendor qualification process went smoothly, giving us confidence in our choice. However, within just a month of operation, one of the machines started malfunctioning due to a failure in the water cooling system. Despite the dealer’s assurance of timely repairs and replacements within the warranty period, we faced delays in getting the machine back up and running. It took 2 months to finally have the machine repaired, thanks to the efforts of our Maintenance team. Although the dealer had promised excellent customer service and quick resolution of issues, we found a lack of alignment between their competitive strategy and supply chain function. This disconnect resulted in unnecessary delays and frustrations for us as the end users. The partnership we had hoped for with the dealer did not live up to our expectations. ▪ The Most Interesting Fact ▪ To add to the disappointment, the salesperson who had initially sold us the machines contacted me after 6 months from a different number to inform me of his move to a new dealer. It was an interesting twist that left me wondering about the continuity and reliability of partnerships in the welding machine industry. #strategicplanning #competitivestrategy #vendorevaluation #projectprocurement

So, we work with several sheet materials suppliers, and here’s something interesting I’ve noticed on LinkedIn over the past few months: A sales rep from supplier A leaves and joins supplier B. A sales rep from supplier B leaves and joins supplier C. A sales rep from supplier C leaves and joins supplier A. To add to the fun, they even inherit each other’s mobile numbers, so I’ve had to update my contacts list by simply changing names. This seems to be a common trend not only in the sheet materials industry but also in the brick industry. It’s like there are a few companies, and staff migrate from one to another. Shall we call it the ‘Cycle of Life’ of the sales rep in our industries?
