"Many of the most vulnerable in our society – including unaccompanied asylum-seeking children, victims of domestic and sexual violence, and victims of torture and trafficking – cannot find a lawyer to take on their asylum or immigration matter despite being entitled to legal aid." Duncan Lewis Solicitors Ltd., one of the largest providers of civil legal aid in the UK, is launching legal action to challenge the Lord Chancellor over rates of pay for immigration and asylum legal aid work, which have not increased since 1996. The Guardian recently reported that this equates to "a drop in real terms of 48%." The firm point out that "providers of legal aid cannot afford to do crucial work on asylum claims and appeals any longer as they suffer financial losses for every case that they take on. As a result, vulnerable people cannot find lawyers to represent them." According to figures from #lawsocietygazette, there is a huge gap between the demand for legal assistance and those who are actually getting the help they need: from 2019-2023, there was a 159% increase in the number of asylum applications made, but only a 32% increase in the number of matters opened by civil legal aid providers. "Without professional legal help, many asylum seekers (...) with legitimate claims face a real risk of deportation back to their home countries, where many of them face potential arrest, assault or even death. Only about 30 percent of migrants are now able to find a lawyer to represent them in legal proceedings, compared with 65 percent five years ago, according to an analysis by the Transactional Records Access Clearinghouse, a research group at Syracuse University." We know that the chances of winning an asylum case increase exponentially with access to an attorney, but legal fees are often prohibitive for families forced to flee their home countries at a moment’s notice. 📢 Duncan Lewis is challenging the government in court over failures to raise legal aid rates for immigration and asylum work or take any other action to address problems in provision in a timely and effective way. This neglect has left vulnerable individuals struggling to find legal representation for crucial asylum cases, highlighting an urgent need for reform. Public Law Solicitor Jeremy Bloom says: "Legal aid will never be wildly profitable, and that’s ok. But providers of legal aid cannot continue taking on work that causes financial losses. It is not sustainable, and the losers are the people who need representation." A new report released today by Castan Centre Academic Member Associate Professor Samantha Currie exposes how representing people with lived experience of modern slavery is made more challenging as a result of UK Government policies. The perilous state of the UK legal aid market is combined with changes to immigration and asylum law which row back on protections afforded to victims and survivors of trafficking and modern slavery. The legislative reform has been accompanied by consistent use of anti-lawyer rhetoric by members of the Government. These research findings underline the negative impact that working in the anti-trafficking space can have on the well-being of practitioners. The report highlights the risk of already entrenched capacity problems in the immigration legal aid sector being compounded due to lawyers seeing trafficking casework as unsustainable in the long-term. In turn, there are serious repercussions for access to justice and effective remedies for people with lived experience of human trafficking. The report is based on research funded by a The British Academy Mid-Career Fellowship and draws on interviews carried out with legal practitioners. A foreword to the report is provided by Dame Sara Thornton DBE QPM, Professor of Practice in Modern Slavery Policy at the University of Nottingham Rights Lab (UK) and former UK Independent Anti-Slavery Commissioner.

LEGAL NEWS: Duncan Lewis Solicitors Ltd. takes government to court over legal aid fees National firm Duncan Lewis is taking the government to court over legal aid fees for immigration and asylum work. The national firm filed a claim in the High Court last Friday challenging the failure to raise legal aid rates for ‘controlled work’ or take any other action to address problems in provision in a timely and effective way. The firm says a 48% real-terms cut in rates since 1996 - when fees were last increased - has left thousands of vulnerable people eligible for legal aid. Jeremy Bloom, lead solicitor at Duncan Lewis, said: ‘It is heartbreaking for us, but over the last five years we have had to make massive reductions in the number of legal aid asylum claims and appeals that we take on. Legal aid will never be wildly profitable, and that’s ok.' 'But providers of legal aid cannot continue taking on work that causes financial losses.
