QBE Specialty Insurance Co. has issued no less than 10 insurance policies for the City of Miami and its elected officials, including Commissioner Joe Carollo, to cover damages if they used their government offices to violate civil rights. Miami taxpayers paid millions in premiums for these policies, and since 2018, QBE has been paying the lawyers who have defended Joe Carollo’s conduct, to the tune of $10 million in attorneys fees. Now that a federal jury held Carollo liable for $63.5 million, including punitive damages, which a federal judge has refused to reduce because Carollo had “used his position and power to weaponize the City government against Plaintiffs” and had "specifically targeted Plaintiffs’ financial vulnerabilities by attempting to shut down their, or their tenants’, businesses,” QBE has reneged on its insurance policies and refused to pay the judgment. In response to the complaint we filed against QBE seeking to recover the compensatory damages portion of our judgment, QBE has now filed its own complaint seeking to renege on all of its insurance policies for any claims made, based upon Joe Carollo’s conduct for the past five years, arguing that it, QBE, is not liable because the damages arose "dishonest, fraudulent, criminal or malicious acts” by Carollo and because Carollo’s allegedly “fraudulent, criminal and malicious acts” were known to the City of Miami since 2018. https://lnkd.in/e2bmkN6R.

𝐋𝐀𝐖𝐘𝐄𝐑𝐒 𝐖𝐄𝐄𝐊𝐋𝐘 PDP Partner John Cloherty was interviewed by Massachusetts Lawyers Weekly regarding a recent insurance coverage decision issued by the U.S. Court of Appeals for the First Circuit. In its decision reversing an order that granted summary judgment to an insurer, the Court held that an owner of a commercial property destroyed by arson did not breach the terms of its insurance policy by questioning the need to present the company’s president for an “examination under oath” as part of the insurer’s claim investigation. Based upon his experience as an insurance coverage litigator, John stated: “[b]y presenting one person to testify in an examination under oath and then questioning the need for further examinations under oath, that does not in my view violate [an insured’s] duty to cooperate with the insurer.” Nevertheless, as it related to the insured's Chapter 93A counterclaim, John noted: “I suspect there are other grounds as well that would justify a disclaimer of coverage, and that would undercut any claim that they violated their duties as an insurer under 93A.” The case is captioned 𝑃ℎ𝑖𝑙𝑎𝑑𝑒𝑙𝑝ℎ𝑖𝑎 𝐼𝑛𝑑𝑒𝑚𝑛𝑖𝑡𝑦 𝐼𝑛𝑠.
