The Financial Conduct Authority (FCA) has this week written a “Dear CEO” letter to 42 investment platforms and SIPP operators setting out its concerns on the way they deal with any interest earned on customers’ cash balances The regulator is also concerned many firms it has surveyed are retaining interest on funds invested by their customers and charging them a fee (“double dipping”). The letter requires that firms review their approach including the returns they are providing customers and their fees, to ensure they are providing fair value. The letter also makes clear that firms need to cease the practice of double dipping. Firms have until 29th February 2024 to review their arrangements and if necessary, make changes. The regulator has made It clear they will intervene where firms are found to be non-compliant. The setting of a deadline in so early in 2024 shows a high level of focus on this issue by the FCA. The Dear CEO letter also makes clear the FCA expects firms to: - review and update their terms and conditions; - ensure their communications meet the rules under the customer understanding outcome; - ensure foreseeable harm to customers is avoided, by ensuring products are designed to meet the needs of retail customers; and - consider appropriate communications to discourage customers from holding large, uninvested balances on investment platforms on a long term basis.
