Happy First Day of Skooool!

Pregnancy is a medical condition. It requires assessment, evaluation and treatment. Yet, it is the only medical condition in which the affected is unable to choose how to treat it. I am seeing a disturbing rise in cases in which mothers are practically begging for a C-Section, and being denied, only to see their babies suffer injury through birth trauma that would have likely been avoided with a C-Section. Doctors often try to tell me in deposition that a C-Section is a risky procedure for mom, however, they also share with me a near 100% success rate in performing C-Sections without maternal morbidity or mortality. What they do not like to share in deposition, is who or what is influencing them to keep their C-Section rate low. Pretty frustrating stuff for a curious little monkey like me. So, allow me to ask a wider forum (please respond publicly or privately): Where does the push for a lower C-Section rate come from, and why such stress in keeping the C-Section rate low?

Always an honor to speak to some of America’s bravest heroes at Association of Women's Health, Obstetric and Neonatal Nurses (AWHONN). While we often find ourselves in an adversarial stance, during the timeouts I enjoy working together to discover best practices to avoid adverse outcomes. At this session, I open my playbook and show nurses where liability is found in hopes that we can minimize medical errors and mistakes which result in severe injuries to newborns and mothers. I am often asked why I switched from doing Medical Malpractice from the defense/healthcare side, to representing the affected patients and their families on the plaintiff's side. It is a good question. To start, I have a passion for healthcare and healthcare providers. I often joke that being a Medical Malpractice attorney satisfies my Jewish mother who pushed for me to be a doctor, as for the past dozen years, I have studied medicine far more than I have studied the law. The real reason is multifaceted: 1. I have a vested interest in ensuring that my local hospitals and healthcare provides are among the best in the state, country and world. After all, there are only two types of humans: those who are under the care of healthcare providers, and those who eventually will be. Assuming the function of Risk Management, I do Root Cause Analysis with the goal of improving outcomes and minimizing adverse incidents. 2. I could not overcome the inherent conflict between the doctors I was hired to represent, and the insurance companies who hired me. I often found doctors who knew they could have done things different and/or better but were saddled with defending their care because their insurance company wanted to send a message by not settling their claim and forcing a family to go through years of litigation to get to a compromised settlement. 3. I was good at it, and in being good at it I felt that I was helping normalize substandard medicine. After watching a few worthy families leave the courthouse in tears, I felt a calling to be an advocate for them. In the end, both sides serve the same master: the standard of care. I enjoy this work, because it is meaningful. I have great confidence in my cases because in most states a medical malpractice case cannot get off the ground without support from the medical community itself.
