A question I am often asked by friends, family and colleagues is “how do you work in family law? Isn’t it depressing?” My answer is usually yes, and I have gone so far as to tell junior solicitors not to work in the field because of this (and other reasons). The fact is, while family law can be downright depressing, overwhelming, intense, emotional and unforgiving, it is also extremely rewarding, meaningful, relevant, interesting and challenging in the best possible way. When I studied law at university, we were required to choose between criminal law and family law for the practical component of the Diploma of Legal Practice. Without a second thought, I chose criminal law, as there was nothing about family law that appealed to me in any way. Fast forward to now, and I couldn’t give it up. BUT I also couldn’t work solely in family law, because there is no denying how hard it is. It is hard on you mentally when a Judge is firing questions at you that you may not have the answers to. It is hard on you intellectually because the law is particularly complex and ever-changing. It is hard on you emotionally when a client hasn’t seen their children in months or worse still, has their children taken away from them. Or when a woman who has suffered domestic violence is locked out of the family home by her abuser. Or when a client calls you in tears because their ex has threatened to “take them for all they’re worth”. It’s the flip-side that makes me want to keep doing it until I retire. It’s the feeling you get when your client is reunited with their child, or awarded a fair settlement that allows them to start fresh. It’s the feeling of working tirelessly on a matter for YEARS and finally getting the client the outcome they deserve. Most importantly, it’s being a part of a system which, despite its flaws, plays an integral part in keeping children and families safe and raising awareness of domestic violence and the impact it has on all of us. So yeah, family law is depressing. But I love it. #familylaw #familylawyer #domesticviolenceawareness

What do judges need to know? I've been thinking a lot lately about what family law judges need to know to help families. So many of our judges -- at least in Colorado -- don't come to the bench with experience in family law. I've done judicial education on family law and domestic violence issues since my University of Michigan faculty days decades ago. But there seems to be more that needs to be done. I have some ideas, but I want to know what others think -- lawyers, judges, participants in the courts. So, wise people, I'm asking you for your thoughts. When is an issue considered urgent enough to be heard by a Court quickly in family law? Here are some examples: > Determining the location and/or recovery of a child > Serious breaches of Parenting Orders > Family violence > Risk of harm to a child/ren > Child abuse or neglect Urgent applications to the Family Law Court can be made without the assistance of a family lawyer. However, the most effective way to ensure that your issue has the best chance of being dealt with in the shortest time frame possible, and avoid the process being slowed down due to errors made in the application process, is to seek the assistance of an experienced family lawyer. While it may be incomprehensible to think that your urgent matter could be slowed down because of the process, the reality is that there are countless other applications that are serious in nature as well, and the application process is required to manage and process them. If you or someone you know is in need of urgent assistance for family law related issues like these, seek legal advice early. It is essential in matters like these, especially where safety is a concern.
