Because the Unified Patent Court operates alongside national courts, will there be an increase in litigation in the near term? Hear from Rolf Claessen 💡 at Michalski · Hüttermann & Partner mbB on AccelPro IP Law. "At the moment, the strategy seems to be that parties are still suing the other parties nationally. And in parallel, they also sue them with the UPC. So maybe in the short term, we will see a slight increase in overall numbers of patent litigation cases in Europe. But there is a time frame of about seven years at the moment. The Federal Circuit denied the petition for a panel or en banc rehearing of the court's obviousness-type double-patenting decision in the 2023 In re: Cellect, LLC. case. The court determined in 2023 that patents that cover overlapping inventions and have different expiration dates due to patent term adjustment (PTA) can be invalidated for double-patenting. Will there be any future proceeding? This will continue to be one of the top issues that companies (and their patent attorneys) will be watching for the rest of 2024.
