Your Favorite Mass Tort Attorney's March 2024 Mass Tort Power Rankings Disclaimer - because I am a lawyer after all - the below Power Rankings focus on which cases I would recommend acquiring at the current environment. New Mass Torts are trying to move up the rankings, but our old favorite aren’t ready yet to hand over the reins just yet. How much longer can they hold on to the top spots?   1. Roundup – Not even a defense verdict and mistrial on the same day can knock Roundup from the top spot. 54,000 pending cases with Plaintiff verdicts expected in Philly and CA next week.    2. Hernia Mesh – Bard Hernia Mesh mediation kicked off this week – time is limited for this tort. 3. Uber Sex Assault – climbing one spot into the top 3 for the first time. Master Long Form Complaint was recently filed.  Defeating the Motion to Dismiss the next big hurdle.    4. Hair Relaxer – moving up on spot, the litigation is moving forward nicely but still pre-Daubert. 5. CPAP – Dropping 2 spots in the rankings: The strong liability picture but coming up on 3 year since market withdrawal – focus on 4 and 5 year SOL states.    6. Ozempic – Initial Case Management Conference scheduled for next week. This litigation is set to take off and will likely be in the top 3 before the end of 2024.   7. PFAS/AFF -not much has changed – keep the criteria tight with only on tier 1 cases. 8. Suboxone – cracks the rankings for the first time in 2024 with 10,000 cases expected to be filed.  Be mindful of the warning change in 2022 for SOL purposes.  9. Bard Power Port – moving down one spot from last week – not a ton of buzz or cases expected in this Mass Tort.     Ones to watch: Baby formula autism; video game addiction; and human trafficking hotel abuse litigation.   Has me nervous: Paraquat – still no Daubert ruling in months doesn’t appear to be a great sign   Too late to the game: Talc and Camp Lejeune What did I get wrong? #joedoeslaw #masstorts

But we aren’t there quite yet.  1. Roundup – No Mass Tort is knocking off Roundup from the top spot. 2. Hernia Mesh – Settlements could be approaching – time is limited. 3. CPAP – the manufacturer stopped selling devices - the liability picture is strong. Only a few months left on SOLs so be careful. 4. Uber Sex Assault – moving up one spot in the rankings positive buzz around this tort. 5. Hair Relaxer – in the pre-Daubert phase filings have stalled – which cases will be viable? 6. Ozempic – MDL formed in a favorable venue with the biggest and most powerful firms all in. The most talked about Mass Tort of 2024 – at this stage run tight criteria.  7. PFAS/AFF -single Plaintiff cases are finally moving but leadership warns to focus only on tier 1 cases. 8. Bard Power Port - rounding out the ranking Honorable mention: Suboxone – MDL formed help but not a ton of excitement. AFLAC's violation Hipaa caused by their assessment beyond 5/15/12, Abbott's last day of active work triggered an additional payment of $10,000 which Jasper Vaughndale Abbott Esquire, (37) Atlanta, GA based Personal Injury Defense Attorney ( Now Plaintiff's Attorney and Georgia Super Lawyer Rising Star https://lnkd.in/gj8m2anx opined the $10,000 was paid to preempt a lawsuit by James Frank Abbott. James Frank's former employer possessed Dr George A Harris's assessment of prescription interaction as a probable cause of James Frank mood swings yet chose to terminate Abbott ( Former Presiding Judge Charles Atwell effective 7/9/12) as being "unfit for duty". James Frank is a skilled inductive reasoner. His use of scattered facts converted into tapestries leading to truth have resulted in an assessment for civil litigation involving 2 counties conspiring. James Frank has proven that there is no qualified nor absolute immunity due to prosecutorial misconduct and is prepared to prove based upon clear and convincing evidence ( fraud standard) fraud on court and beyond a shadow of doubt that Abbott was a victim of aggravated kidnapping ( KS Class 1 felony) by Gerald Buckner, Senior Patrol Officer, Midtown Patrol, Sergeant Katie Yarsulik, Commander, 12/22/12, Kansas City KS Police Department in Conspiracy with Wyandotte County KS Adult Detention Center, Jeff Fewell, Former Superintendent . There is no Statute of Limitations for Fraud on Court nor KS Class 1 Felony. Wyandotte County KS Adult Detention Center (12/26/12) and Carl E Cornwell II (1/29/13) attempted to get Abbott to voluntarily submit to be extradited to Missouri. Patrick Abbott, Joint POA advised James Frank on 12/26/12 in a visit not to submit thereby preserving rights. Patrick secured Abbott's release from Detention after 177 without due process on 8/28/12 by going repeatedly to 1300 Cherry Detention Center Health Administrator Carlos Delgado due to Abbott's rapidly declining health ( Ejection Fraction 10). alhamdulillah.
