Before continuing scrolling: take a pause to consider the meaning and the profound impact of the rule of law! 🌍📜 Recently, the latest Rule of Law Report by the European Commission was published. This comprehensive document underscores the essential pillars that uphold our democratic societies: justice, anti-corruption measures, media freedom, and institutional checks and balances. One of the report's key insights is the critical role of an independent judiciary. It serves as a cornerstone for upholding the rule of law, ensuring that laws are applied fairly and consistently. This resonates deeply with our ongoing discussions about the importance of impartial and transparent legal systems, and the role of Supreme Court and Constitutional Court judges. The report also highlights the pervasive issue of corruption, especially in Austria, emphasizing the need for robust measures to combat it. Effective anti-corruption frameworks not only bolster public trust but also create a more equitable and just society. Media freedom is another crucial element examined in the report. A free and pluralistic media landscape is vital for democracy, providing citizens with the information they need to make informed decisions and hold power to account. This has recently prompted me to think: maybe it is time we should add the media as an independent pillar in the classical framework of separation of powers. Finally, the report stresses the importance of institutional checks and balances. These mechanisms are essential for preventing the abuse of power and ensuring that all branches of government operate within their constitutional limits. The Rule of Law Report is a stark reminder that the principles we study and uphold in our legal practice are not just theoretical constructs. The Rule of Law report 2024 is out, and it shows, when it comes to Bulgaria: • Some progress on: -taking steps to adapt the relevant legislative framework longterm secondment of judges to fill in vacant positions, taking into account European standards on secondment of judges; -advancing with the preparation of legislative amendments aiming at improving the functioning of the Inspectorate to the Supreme Judicial Council and avoiding the risk of political influence, in particular by involving judicial bodies in the selection of its members; -advancing with the work aimed at improving transparency in the allocation of state advertising, in particular with regard to state advertising contracted through intermediaries, such as media agencies • No progress on: -ensuring an improved effectiveness of investigations and a robust track record of prosecution and final judgments in high-level corruption cases and significant progress on the institutional reforms of the Anti-Corruption Commission; improving the integrity of top executive functions, taking into account European standards, in particular by ensuring that clear integrity standards for the Government as well as an appropriate sanctioning mechanism are in place. •Full implementation on: -the recommendation to step up efforts to adapt the composition of the Supreme Judicial Council, taking into account European standards on Councils for the Judiciary. Country-specific recommendations to Bulgaria: • Take steps to adapt the relevant legislative framework to avoid long-term secondment of judges to fill in vacant positions, taking into account European standards on secondment of judges. • Advance with the draft legislative amendments aiming at improving the functioning of the Inspectorate to the Supreme Judicial Council and avoiding the risk of political influence, in particular by involving judicial bodies in the selection of its members. • Take forward the plans to adopt a mechanism for introducing safeguards in the appointment procedure of the Parliament-elected members of the Supreme Prosecutorial Council, ensuring their independence and taking into account European standards, particularly in view of the Council’s role in the appointment and dismissal of the Prosecutor General. • Ensure a robust track record of investigations, prosecutions and final judgments in high-level corruption cases and the effective performance of the Anti-Corruption Commission. • Improve the integrity of top executive functions, taking into account European standards, in particular by ensuring that clear integrity standards for the Government as well as an appropriate sanctioning mechanism are in place. • Further advance with the work aimed at improving transparency in the allocation of state advertising, in particular with regard to state advertising contracted through intermediaries, such as media agencies.
The Rule of Law reports show that 2/3 of last year's recommendations have been addressed. These reports, an innovation of this mandate, have helped strengthen the Rule of Law in Europe. #Europe🇪🇺 The #RuleofLaw is fundamental for every EU citizen and business, ensuring the protection of rights, the application of EU law, and a favorable investment climate. It is integral to the EU’s identity. The annual Rule of Law Report, based on a consistent and transparent methodology, evaluates the state of the rule of law across all EU Member States and four enlargement countries. It highlights significant developments, offers recommendations, and tracks progress in implementing previous recommendations. This preventive report aims to promote and sustain the rule of law, complementing other EU mechanisms such as infringement proceedings and Article 7 procedures. Since 2020, new EU initiatives like the European Media Freedom Act and the Anti-Corruption Package have been introduced based on monitoring results.
