#H1BFY2025 Cap Update and Next Steps 🚀 Exciting news!🎉 USCIS has announced that a second H-1B cap lottery will be held this year, targeting the "regular cap" of 65,000 H-1B visas. These visas are available to individuals with a Bachelor's degree or equivalent (or higher). #WhatHappened? This year's lottery process introduced a "beneficiary-centric" approach aimed at enhancing fairness and reducing system abuse. Under the new process each individual was only counted once in the lottery, no matter how many companies submitted registrations on their behalf. USCIS just dropped the final rules overhauling visa fees and the lottery system for H-1B specialty occupation visas. The lottery will shift to a beneficiary-centric model, giving each worker the same chances no matter how many registrations are submitted on their behalf. Meanwhile, registration fees for the specialty occupation visas are set to rise from $10 to $215 in the new fee rule. #H1B #immigration #visas

The US Citizenship and Immigration Services (USCIS) has announced a final rule implementing increased premium processing fees for certain visa categories, including H-1B visas used by specialty occupation workers. This change is effective February 26, 2024. Immigration attorneys advise sponsoring employers to factor this new fee structure into their immigration budget planning for the upcoming year, particularly considering the typical H-1B application timeline involving E-registrations in March, followed by the lottery, and then final applications for selected beneficiaries. FY2024 Cap is a wrap! On December 13, 2023, U.S Citizenship and Immigration Services (USCIS) announced that they received enough H-1B petitions to reach both the congressionally mandated 65,000 H-1B visa regular cap and the 20,000 H-1B visa master’s cap for FY 2024. Over the next few days, USCIS will send non-selection notices to registrants through their online accounts. Meanwhile, practitioners and employers will gear up for the FY 2025 H-1B cap registration lottery which expected to open in March 2024. If the proposed changes released by USCIS on October 23, 2023, are implemented, it is anticipated that there will be a more streamlined H-1B process where registrants will be selected as individuals and not based on the number of registrations. #USCIS #H1BCAP #CAP #Immigration #ODImmigration

The H-1B lottery was a mess this past year. It started out with hundreds of thousands of duplicate filings, then there was a second selection in July and until today everyone has been left in limbo, assuming that they were not selected but not knowing for sure until today. The fiscal 2024 H-1B lottery is officially complete. It is now time for employers to contact immigration counsel with the list of applicants for the upcoming H-1B season. Employees with OPT and STEM OPT are the most obvious candidates but don't forget about surveying your overseas offices for potential transferees who may not qualify for L-1 visas or even current employees with H-4 EADs, L-2S or E-1S who are dependent on the continued employment of a spouse. #H1BLottery #WRImmigration #USworkvisa https://lnkd.in/dSDafcW2

The H1-B visa lottery for 2025 just opened up and the odds are definitely better than they were last year when it comes to the first-round selection. But the annual caps are still abysmally low – there just aren’t enough visas for the number of visas needed to attract and retain talent to the US. 🇺🇸 USA alert: Employers have just two more weeks to file petitions for foreign nationals selected in the FY 2025 H-1B cap lottery before the end of the filing period on June 30, 2024. It is not yet known whether USCIS will conduct a second lottery for cap employment in FY 2025.
