I won't pretend to be a legal expert or to know all of the factors involved in the "arguments" in the legal discussions before the Supreme court but, IMHO, I viewed the range of questions asked by the Supremes to be very limited and that possible exceptions were ignored. There appears to be a question that seems to be driving the Supremes, namely, "why a single state should be able to decide who should be on the ballot in a national election". I have to asked, don't we already have this happening in every election? Not all people running for president appear on all state ballots, for a variety of reasons, some of which are purely political (i.e., keeping certain people off the ballot because they would draw votes from another candidate). In any event, the Supremes will probably be very narrow in their decision if they don't punt this year.

Excerpts taken from the hearing notes: More than 20 states have passed legislation clarifying that DPC arrangements are not insurance, and therefore not subject to myriad insurance requirements and inefficiencies. The bill will get a committee vote tomorrow (Feb. 9) and could reach the full Senate floor later this month. Dr. Molaska described how her DPC practice should not be mistakenly considered “concierge” care, which is sometimes portrayed as a system for the “healthy and wealthy.” Instead, Dr. Molaska described her arrangements as “concierge for the blue-collar crowd,” sharing how her monthly subscription charge is “often less than someone’s cell phone bill,” and often passing on significant savings on procedures and drugs through her arrangements with suppliers. She also stressed that she advises patients to also carry regular health insurance, which can cover much of the cost of catastrophic care. Please contact your representatives in SUPPORT of these bills which will help *define* DPC as a contract DIRECTLY “between a health care provider that provides primary care services under the provider's scope of practice and an individual patient, or the patient's legal representative, or an employer in which the health care provider agrees to provide primary care services to the patient or employee for an agreed-upon subscription fee and period of time.” This will also *protect* DPC practices from the application of insurance law. DPC is NOT insurance. No middlemen between us and our patients. DPC is medical care in which patients and physicians can remain ALIGNED in our mission for price transparent, high quality, relationship-based and personalized care.
