At the recent meeting of the International Civil Aviation Organization (ICAO) dangerous goods panel, it was agreed to introduce a State of Charge (SoC) requirement of 30% for more categories of lithium ion batteries being transported by air. This change will apply to lithium ion batteries packed with equipment – where a device has its battery packed in the same box. Currently the SoC requirement only applies to lithium ion batteries shipped by air on their own by air.

The European Court of Justice (ECJ) ruled in case C-385/23 that technical failures affecting a new aircraft model recently put into service where the manufacturer of that aircraft recognises that the failure was caused by a hidden design defect conerning all aircraft of the same type and impinging on flight safety are covered by the concept of extraordinary circumstances within the meaning of Article 5 (3) of Regulation (EC) No 261/2004. #weisenheimer #aviationlaw #airlines #aviation #passengerclaims

[PRESS RELEASE] ACI EUROPE today took stock of changes to the EU Aviation Security Regulation which introduces severe restrictions to the use of next generation (C3) cabin baggage scanners at airports in the EU and EEA. The new restriction introduces, as of 1 September 2024, a 100ml limitation for individual containers of liquids – thus erasing the main benefit for passengers from C3 scanners. It will result in significant operational strain for airports, decreasing passenger throughput at security checkpoints that will need to be mitigated with the deployment of additional staff and reconfiguration where feasible. The new restriction penalises airports that have already invested in C3 scanners to improve passenger experience, as little of the intended benefits will materialise – yet the significant purchase and operational cost of C3 scanners remain.
