Hot off the press 📣... The third round of implementation of the Charities Act 2022 happened today. The Charity Commission has recently opened an inquiry following serious concerns raised regarding an event held at a charity’s premises. Reading into some of the details, it has taken what feels like a slightly unexpected twist. The outcome of this investigation may raise concerns for Trustees of charities which allow use of their properties by third parties. The current investigation is into a remembrance event held in the charity’s premises by a third party and NOT the charity itself, footage provided to the Charity Commission has shown that anti-Semitic chants were being made during the event. The regulator has now understandably prohibited the trustees from allowing the charity’s premises to be used by the third party that organised the 2020 event. However, the Commission is now inquiring, amongst other things, into the oversight and control by the charity’s trustees of the use of the charity’s properties by third parties. The scope of this inquiry raises questions over the lengths of due diligence that Trustees are expected to undertake into the third party, and their proposed event, before allowing them to hire the premises. The Charity Commission will publish their report detailing the issues examined and any action taken – this is certainly an investigation to follow if you allow use of your properties by third parties.
