I was asked by Law360 about the Post Office scandal’s implications for private prosecutions. I emphasised that the Post Office’s wrongful prosecution of hundreds of innocent sub-postmasters for fraud and false accounting should not lead to a "knee-jerk political reaction." But I said the case’s failings regarding tainted evidence and disclosure raised questions about allowing organisations to investigate and prosecute alleged offending themselves. I added that there remains a need for private prosecutions, although lawyers involved in them may have to accept additional regulation and accountability as a result of the scandal. This pertains notably to economic offenses and the use of strategic lawsuits against public participation (SLAPPs).
