“Shlomo, so what exactly do you do?” 🤦🏻♂️ Well, since 2010, I’ve been working out distressed loans on behalf of Borrowers. First and foremost, I’m a creative property guy. I’m also a strategist, therapist and negotiator. I also advise some of the largest borrowers and law firms on how to work with aggressive lenders. But please cut me some slack and give me 90 to 120 days before you default. We need a goal and we need a path before going to war. Actually, if I had my druthers, I prefer multiple paths. -> default or not? -> realistic expectations? -> strategy (bills? leases? go to market? etc) -> Which attorney to hire? -> Set goals: - Give back keys with a release of guarantee? - Discounted payoff? - Modification/extension? - Rescue capital? _______________ Some success examples >> Regional Bank: Release of Guarantee >> CMBS: Extension of loan >> CMBS: Give back and release of Guarantee >> CMBS: A/B Note Modification >> CMBS: DPO >> CMBS: Bondholder Deal/ DPO/ Financing

I call this theft of intelectual capital. A potential lead will call me with a problem and I will give them my advice and time. Then, they take my ideas, go back to their untrained, less experienced, in the box thinking loan officer, and they tell me- “Thank you but my previous Loan Officer can do this too, so we are staying with him!” How do you deal with these types of situations? 🤨 #AnnZeilingold #loanofficer #expert

What are the pitfalls of private lending? We love the space. It would be very guru-like of me to always talk about the benefits but never the potential loss. The key point of failure almost always is a flawed underwriting process. The five c's of lending: Capacity, Character, Credit, Collateral, and Conditions. A major miss on any of those is courting a loss of loaned funds. Our process is structured to mitigate a mistake made in the process. While I no longer practice law....lessons learned in the bankruptcy world are put to good use. We love the mezzanine structure. We don't loan to own. We want our capital to be deployed successfully by our borrowers. We could recover the deal and almost certainly break even in the event we have to take drastic measures. Interest in the project LLC as collateral is our superpower.
